WHAT DO MANUFACTURERS NEED TO BE<br />
AWARE OF?<br />
For peace of mind and to avoid potentially<br />
longer waiting times caused by high demand,<br />
manufacturers should continue working on<br />
getting their conformity assessment certifications<br />
if they have not already done so. To place lifts<br />
(into use) onto the Great Britain market from<br />
1 January 2023, manufacturers who depend<br />
on approvals under EU type-examination<br />
certificates and EU design examination<br />
certificates must have these approvals<br />
transferred to a UK Approved Body by the end<br />
of <strong>2022</strong>. Equally, for the safety components of<br />
lifts to be placed on the<br />
Great Britain market<br />
from 1 January 2023,<br />
manufacturers and<br />
importers depending<br />
on EU Notified Body<br />
approvals must have these<br />
approvals transferred to a<br />
UK Approved Body by the<br />
end of <strong>2022</strong>.<br />
EU Directives cannot<br />
be put into effect in<br />
individual EU member<br />
states until they are<br />
transposed into local<br />
law. For the UK, the EU Lifts Directive was<br />
introduced as the Lifts Regulations through<br />
Statutory Instrument 2016 No 1093, which<br />
became the legal basis for all lift regulations<br />
and standards<br />
in the UK. Post-Brexit, the UK Lifts<br />
Regulations had exactly the same technical<br />
requirements as the EU Lifts Directive. The list<br />
of UK “designated standards” which give a<br />
presumption of conformity to the<br />
essential requirements of<br />
the UK Lifts Regulations is essentially<br />
the same as the list of harmonised standards<br />
used to confer a presumption of conformity<br />
under the EU Lifts Directive. Although<br />
the UK will now be able to<br />
change the UK Lifts Regulations, initially,<br />
the technical requirements for lifts<br />
and safety components for lifts are aligned.<br />
Therefore, in seeking re-certification under<br />
UKCA-marking rules, in most cases, the<br />
evidence of EU type-examination is<br />
expected to be sufficient<br />
for the UK Approved Body. However, it is best<br />
to check early with a UK Approved Body.<br />
HOW MANY APPROVED BODIES ARE THERE?<br />
As of 1 January 2021, ‘notified bodies’ in the UK<br />
became ‘approved bodies’, and manufacturers<br />
wishing to sell goods in the UK market will need<br />
to secure the services of one accredited in the<br />
UK. Suppose manufacturers also want to place<br />
their products on the EU market. In that case,<br />
they will also need to have<br />

Per stare tranquilli ed evitare tempi di attesa<br />
eccessivi, considerata la domanda elevata, i<br />
produttori, se non l’hanno già fatto, devono<br />
attivarsi per ottenere le necessarie certificazioni<br />
di conformità. Dal 1° gennaio 2023, per mettere<br />
in uso un ascensore sul mercato britannico, i<br />
produttori, che devono essere in possesso delle<br />
omologazioni di cui ai certificati di valutazione<br />
UE e ai certificati di progetto UE, devono<br />
provvedere alla trasmissione di tali omologazioni<br />
all’Ente autorizzato britannico entro la fine del<br />
<strong>2022</strong>. Per i component di sicurezza da immettere<br />
sul mercato UK a<br />
partire dal 1° gennaio<br />
2023, i produttori e<br />
gli importatori che<br />
dipendono dalle<br />
omologazioni di un<br />
ente notificato UE<br />
devono trasmetterle a<br />
un ente autorizzato UK<br />
entro la fine del <strong>2022</strong>.<br />

uno stato membro senza<br />
la relativa normativa<br />
di recepimento<br />
locale. Per quanto concerne il Regno Unito, la<br />
Direttiva Ascensori UE è stata recepita come Lifts<br />
Regulations con lo Statutory Instrument 2016<br />
No 1093, il regolamento attuativo, che è divenuto<br />
la Norma sovrana contenente tutti i regolamenti<br />
e gli standard in vigore nel Regno Unito in<br />
materia di ascensori. Dopo la Brexit, i requisiti<br />
tecnici previsti dalle Lifts Regulations del Regno<br />
Unito erano i medesimi di quelli previsti dalla<br />
Lifts Directive dell’Unione europea. I requisiti<br />
in presenza dei quali sussiste una presunzione di<br />
conformità alle Lifts Regulations nel Regno Unito<br />
sono sostanzialmente identici a quelli previsti per<br />
concedere una presunzione di conformità ai sensi<br />
della Direttiva ascensori dell’Unione europea.<br />
Sebbene il Regno Unito sia ora autorizzato ad<br />
emendare le UK Lifts Regulations, in un primo<br />
momento i requisiti tecnici per gli ascensori e<br />
i relativi componenti di sicurezza resteranno<br />
allineati. Quindi, quando si richiede a un ente<br />
autorizzato inglese la certificazione ai sensi delle<br />
norme di marcatura UKCA, la prova di conformità<br />
UE dovrebbe essere sufficiente; suggeriamo<br />
tuttavia di chiedere un previo riscontro a un ente<br />
autorizzato UK.<br />
QUANTI SONO GLI ENTI AUTORIZZATI?<br />
A partire dal 1° gennaio 2021, gli ‘enti notificati’<br />
nel Regno Unito sono diventati ‘enti autorizzati’ e i<br />
produttori che desiderano vendere beni sul mercato<br />
inglese dovranno assicurarsi i servizi di uno di questi<br />
enti accreditati. Supponiamo che un produttore<br />
voglia immettere i propri prodotti anche sul mercato<br />
dell’UE. In tal caso, dovrà disporre anche di un<br />
