2.3 Special Waste<br />

New Mexico Special Waste Regulations are found in 20 NMAC Chapter 9, Part 1, Section 700 through<br />

Section 712. Management of special wastes is under the control of the Solid Waste Bureau (SWB). A<br />

definition of Special Waste is included in the Definitions section of this plan. All disposal facilities<br />

managing a special waste must have a Waste Disposal Plan for that waste. If they do not, they must not<br />

accept the waste, or it is the responsibility of the generator to prepare and submit a Waste Disposal Plan<br />

to the SWB for approval prior to disposal.<br />

Special Waste must comply with the following requirements:<br />

Special wastes must either be treated prior to disposal and/or isolated in their disposal to ensure<br />

a minimum of exposure to the public.<br />

All special waste must be disposed of only at solid waste facilities permitted for disposal of<br />

special waste.<br />

All special wastes must be manifested in accordance with Section 712 of the New Mexico<br />

Special Waste Requirements Regulations, as specified in Section 5.5.1.1 of this plan.<br />

Storage of special waste will occur only at an approved special waste storage area.<br />

Special waste will not be stored longer than 45 days, unless approved in advance by NMED.<br />

All containers of special waste to be stored or disposed of will be clearly labeled, indicating the<br />

contents and potential health, safety, and environmental hazards associated with the waste.<br />

The physical and chemical characteristics of all special wastes will be documented prior to<br />

storage, transportation, or disposal, by means of:<br />

― Records of the results of analysis performed in accordance with Section 704 as applicable<br />

― Detailed descriptions of the generator's knowledge of specific wastes<br />

Transporters of any type of waste must be registered.<br />

2.4 Surface and Groundwater Discharges<br />

New Mexico Water Management Regulations are found in 20 NMAC 6.2 through 6.4. The NMED<br />

Groundwater Bureau manages discharges to groundwater. Discharges to groundwater (which includes<br />

discharges to the ground surface) require submittal of a discharge plan to NMED; approval to discharge is<br />

issued through a letter from the Bureau. The Surface Water Quality Bureau manages discharges to surface<br />

water (both ephemeral and perennial). The state is not authorized to implement the National Pollution<br />

Discharge Elimination System (NPDES) program. NPDES permits for discharges to surface water must be<br />

obtained from EPA Region 6.<br />
