Documentation of all proposed waste classifications (supported by generator knowledge or through<br />

chemical analyses) will be provided to Kirtland AFB for final waste stream characterization approval.<br />

3.2 Hazardous Waste Management<br />

RCRA Subtitle C and the New Mexico Hazardous Waste Management Regulations (20 NMAC 4.1)<br />

govern hazardous waste management from the point of generation, through storage and treatment (if<br />

necessary), to its ultimate disposal. The NMED-HWB oversees management of the hazardous waste<br />

program in New Mexico.<br />

Hazardous waste must comply with the following requirements:<br />

Waste generated during project activities must be characterized chemically or by using<br />

generator knowledge to determine if it is a hazardous waste (as discussed in Section 4.1).<br />

Hazardous waste must be managed in accordance with 40 CFR Part 262—Standards<br />

Applicable to Generators of Hazardous Waste.<br />

Hazardous waste transported offsite must be manifested in accordance with 40 CFR Part 262,<br />

Subpart B—Manifests, and accompanied by LDR certification notices as per 40 CFR 268—<br />

Waste Analysis and Recordkeeping.<br />

Small quantities of hazardous waste must be stored in accordance with 40 CFR Part 265,<br />

Subpart I—Use and Management of Containers.<br />

All containers of hazardous waste to be stored or disposed will be clearly marked with a<br />

completed hazardous waste label indicating the starting date of accumulation, EPA<br />

identification number, EPA waste code, and DOT labels and markings.<br />

Hazardous waste may be stored onsite for a maximum of 90 days. An initial accumulation start<br />

date (defined as the first date waste is placed in the container) will be placed on the container<br />

and recorded in a log book. A determination of whether a waste, once generated, is hazardous<br />

by using generator knowledge, chemical analyses, or other information will be made within 15<br />

days.<br />

Hazardous waste must be disposed only at a hazardous waste disposal facility approved by<br />

Kirtland AFB and permitted for the disposal of the particular type of hazardous waste<br />

generated. Hazardous waste disposal activities will be contracted, coordinated, and arranged<br />

for by Kirtland AFB personnel. Under no circumstances will the Contractor’s personnel sign<br />

hazardous waste manifests.<br />

3.3 New Mexico Special Waste Management<br />

New Mexico Special Waste Regulations are found in 20 NMAC 9.1; management of special wastes is<br />

under the control of the NMED-SWB.<br />

With regard to this project, New Mexico special wastes (i.e., solid wastes that have unique handling,<br />

transportation, or disposal requirements to ensure protection of the environment and the public’s health<br />

and safety) potentially includes PCS and ACM. For Kirtland AFB, New Mexico has defined PCS as<br />

special waste if the TRPH concentration is greater than 100 mg/kg.<br />
