29-929-9 ENVIRONMENTAL AND RELATED <strong>REGULATIONS</strong>A. SOIL EROSION AND SEDIMENTATION CONTROL PLAN (Hereinafter called "ControlPlan")1. Purpose: To minimize soil erosion and sedimentation resulting from land use changeswhich cause the disposition of sediment in storm drains, ditches, watercourses and ponds,increases the potential of flooding and reduces water quality and supply.2. Basic Requirements: No land development which is cumulatively more than one-half acrein area shall be undertaken in any district unless certification of compliance with theprovisions of this section has first been obtained from the Commission or its designatedagent. No Zoning or Building Permit shall be issued until a Control Plan has beenapproved by the Commission or its designated agent or it has been determined that aControl Plan is not required.3. Definitions: For the purpose of this section, the words and terms hereinafter listed aredefined as follows:Certification. A signed, written approval by the Commission that a Control Plancomplies with the applicable requirements of this section.Development. In connection with a Control Plan, any construction or gradingactivities to improved or unimproved real estate.Disturbed Area. An area where the ground cover is destroyed or removed leavingthe land subject to accelerated erosion.4. Exemption: A single-family dwelling that is not part of a subdivision of land shall be exemptfrom this section.5. Required Submission: The submission of material required to obtain approval of a ControlPlan shall include, but not be limited to:a. The location for the proposed development and adjacent properties.b. The existing and proposed topography, including soil types, wetlands, watercoursesand water bodies.c. The existing structures on the project site, if any.d. The proposed alterations, including areas to be cleared, excavated, filled or graded,and proposed structures, utilities and roads or driveways.e. The location of and design details for all proposed soil erosion and sediment controlmeasures (hereinafter called "control measures") and stormwater managementfacilities.154
