A determination by theCommission that the concept plan is acceptable shall not constitute approvalof the plan by the Commission, nor shall it constitute an obligation on the partof the applicant to construct the proposed facilities shown on the plan.b. The removal of earth materials under this section shall comply with the followingstandards:(1) Excavation and grading shall provide drainage of the property during theearth removal operation and after its completion. There shall be noexcavation within one-half of the building setback of any property line in orabutting a Residential District, within 20 feet of any property line in orabutting a Business District, or within 20 feet of any property line in orabutting an Industrial District. There shall be no excavation within 75 feet ofany dwelling on an adjoining property existing at the date that the permit isissued. The final grade of any excavated slope shall not exceed one foot ofvertical rise per three feet of horizontal distance. Where ledge rock or similargeological conditions are encountered, the Commission may approve asteeper grade but may require fencing or other protective measures tocontrol hazardous conditions.*(2) The maximum depth of excavation shall be no greater than ten feet belowthe grade of the street along which the property has frontage or, if theproperty has no street frontage, no greater than ten feet below the grade ofthat side of the property through which access to the site is provided.(3) The use of buildings, structures or equipment for storing or processing earthmaterials shall be allowed only by Special Permit, as part of the originalSpecial Permit application, as a subsequent Special Permit application onits own, or as part of a renewal application for a previously approvedSpecial Permit.(4) Upon completion of the earth removal operation, all disturbed areas ofthe property, except rock exposed by excavation, shall be covered with aminimum of six inches of topsoil. Such topsoil shall be evenly spread overthe disturbed area, rolled, fertilized and planted with a cover crop suitableto prevent erosion and to hold all slopes. At any time prior to thecompletion of the earth removal operation, the ZEO may require that thoseareas of the property where excavation has been completed be final graded,covered with a minimum of six inches of topsoil, and seeded to establish acover crop.(5) Prior to the renewal of a Special Permit for earth removal, theCommission may require that those areas of the property whereexcavation has been completed be final graded, covered with a minimum ofsix inches of topsoil, and seeded to establish a cover crop.(6) All excavation shall be done in conformance with the requirements of Section29-9.A.158
