29-4.F.It is the intent of these Regulations to permit these nonconformities to continue until theyare removed but not to encourage their survival. It is further the intent of these Regulationsthat nonconformities shall not be enlarged upon, expanded or extended if such a changewould increase the nonconformity, nor be used as grounds for adding other structures oruses prohibited elsewhere in the same district.a. Non-conforming uses are declared by these Regulations to be incompatible withpermitted uses in the districts involved. After the effective date of adoption oramendment of these Regulations, a non-conforming use of land, a non-conforminguse of a structure, or a non-conforming use of a structure and land in combinationshall not be extended or enlarged by the attachment to a building or land ofadditional signs intended to be seen from off the premises, or by the addition ofother uses of a nature which would be prohibited generally in the district involved.b. To avoid undue hardship, nothing in these Regulations shall be deemed to require achange in the plans, construction, or designated use of any building on which actualconstruction was lawfully begun prior to the effective date of adoption oramendment of these Regulations and upon which actual building construction hasbeen carried on diligently. Actual construction is hereby defined to include theplacing of construction materials in permanent position and fastened in a permanentmanner. Where excavation or demolition or removal of an existing building hasbeen substantially begun preparatory to rebuilding, such excavation or demolition orremoval shall be deemed to be actual construction, provided that work shall becarried on diligently.2. Non-Conforming Lotsa. In any single-family Residential district, a single-family dwelling and customaryaccessory buildings may be erected on a lot of record as of the effective date ofadoption or amendment to these Regulations, notwithstanding requirementsimposed by other provisions of these Regulations. Such lot shall be in separateownership and shall not have continuous frontage with other lots under the sameownership. This provision shall apply even though such lot fails to meet the lot areaand/or lot width requirements of the district in which such lot is located, providedthat the yard dimensions and requirements other than those applying to lot areaand/or lot width shall conform to the requirements of the district in which such lot islocated.b. If two or more adjoining lots or combinations of lots, one or more of which areundeveloped, or portions of lots having continuous frontage under single ownershipare of record as of the effective date of adoption or amendment of theseRegulations; and if all or part of the lots do not meet the lot width and/or lot arearequirements of the district in which such lots are located; and if such lots takentogether would form one or more lots each more nearly meeting the requirements ofthe regulations with regard to lot area and lot shape: then the land involved shall beconsidered to be an undivided parcel for the purposes of these Regulations, and noportion of said parcel shall be used or sold in a manner which would diminish63
