29-4.D.c. Any application for the installation of a new, enlarged or replacementtransmission line or substation shall include a current study of thefeasibility of installing such facilities underground and, if required bythe Commission, shall furnish such other data, studies and reports aswill enable the Commission to determine whether the particular facilityfor which a Special Permit is sought should be placed underground.d. Any proposed facility shall be so designed, enclosed and painted, andso screened, that it shall not present a potential safety hazard andshall be harmonious with the area in which it is located. The entirepremises on which such use is situated shall be suitably landscapedand maintained in reasonable conformity with the standards ofproperty maintenance of the surrounding neighborhood.e. Accompanying any application for the establishment orenlargement of a power transmission line shall be a landscapingplan, prepared in accordance with the requirements of 29-8.C. Wherefeasible, such proposal shall also include plans for possible multipleuse of the right-of-way for recreational as well as utility purposes.f. Public utility buildings, structures or uses shall be permitted in allresidential districts subject to Special Permit and Site Planapprovals in accordance with 29-10 and 29-11 and therequirements of 29-4.D.2, a-e, if the Commission determines that:service could not be supplied by a location in a nonresidentialdistrict; a public necessity exists for the facility in the community;the proposal takes into consideration future as well as presentneeds; development of the facility shall occur in such a way as tobe compatible with the residential environment and protectneighboring property values.3. Telecommunication Facilities, Radio or Television Reception or TransmissionFacilities unless otherwise specified shall be permitted in all districts subject to theprocedures and provisions contained within this section. *a. Statement of Purpose: In accordance with the Federal Telecommunications Actof 1996, these regulations are intended to accommodate the needs of residents,businesses and the general public, while protecting the public safety and generalwelfare of the Town, and minimizing any adverse visual and operational effectsof Towers or wireless communication facilities through careful analysis, design,siting and screening. This regulation establishes standards and requirements fortelecommunication facilities and sites. The purposes are to regulate placementof Antennas, Towers, and other related facilities in a manner that will protect theTown's visual quality; and safeguard the community by maintaining specific26
