29-9.Fnew construction, substantial improvements to existing structures, filland the storage of buoyant material shall be prohibited unlesscertification, with supporting technical data, by a Connecticutregistered professional engineer is provided demonstrating, throughhydrologic and hydraulic analyses performed in accordance withstandard engineering practice, that encroachments shall not result inany (0.00 feet) increase in flood levels during occurrence of the baseflood discharge. The Commission may request floodway data forwatercourses without FEMA-published floodways. When such datais provided by an applicant or whenever such data is available fromany other source (in response to the Commission’s request or not),the Commission shall adopt a regulatory floodway based on theprinciple that the floodway must be able to convey the waters of thebase flood without increasing the water surface elevation more thanone (1) foot at any point along the watercourse.*k. Equal Conveyance: Within the floodplain, except those areas whichare tidally influenced, as designated on the Flood Insurance RateMap (FIRM) for the community, encroachments resulting from filling,new construction or substantial improvements involving an increasein footprint of the structure, are prohibited unless the applicantprovides certification by a registered professional engineerdemonstrating, with supporting hydrologic and hydraulic analysesperformed in accordance with standard engineering practice, thatsuch encroachments shall not result in any (0.00 feet) increase inflood levels (base flood elevation). Work within the floodplain andthe land adjacent to the floodplain, including work to providecompensatory storage shall not be constructed in such a way so asto cause an increase in flood stage or flood velocity.*l. Compensatory Storage: The water holding capacity of the floodplain,except those areas which are tidally influenced, shall not be reduced.Any reduction caused by filling, new construction or substantialimprovements involving an increase in footprint to the structure, shallbe compensated for by deepening and/or widening of the floodplain,storage shall be provided on-site, unless easements have beengained from adjacent property owners; it shall be provided within thesame hydraulic reach and a volume not previously used for floodstorage; it shall be hydraulically comparable and incrementally equalto the theoretical volume of flood water at each elevation, up to andincluding the 100-year flood elevation, which would be displaced bythe proposed project. Such compensatory volume shall have anunrestricted hydraulic connection to the same waterway or waterbody. Compensatory storage can be provided off-site if approved bythe municipality.*176
