29-429-4 APPLICATION <strong>OF</strong> <strong>ZONING</strong> <strong>REGULATIONS</strong>A. GENERAL PROVISIONS1. Compliance with Regulations: Except as otherwise provided herein, no land, building orstructure or part thereof shall be constructed, reconstructed, erected, extended, enlarged,moved, arranged, altered or used, or the use changed, or the dimensional requirements oflots, yards or courts changed, except in conformity with the requirements of theseRegulations for the district in which such land, building, structure or use is located.2. Permitted and Prohibited Uses: Any use not specifically permitted by right or by SpecialPermit in a zoning district by these Regulations shall be deemed to be prohibited withinsuch district.3. Determination of Uses: Where a proposed use is not clearly permitted nor clearlyprohibited in a zoning district by these Regulations, the Commission shall make thedetermination as to whether the proposed use is permitted in that district by right or bySpecial Permit, or is prohibited.4. Minimum Requirements: In interpreting and applying these Regulations, the requirementscontained herein are declared to be the minimum requirements necessary for theattainment of the purposes set forth in 29-1.5. Conflicting Standards: Where these Regulations require a greater width or size of yards orother open spaces, or a lower height of building, or a fewer number of stories, or a greaterpercentage of lot area to be left unoccupied, or impose other and higher standards thanrequired by any other statute, bylaw, ordinance or regulation, the provisions of theseRegulations shall govern. Where the provisions of any other statute, bylaws, ordinance orregulation require a greater width or size of yards or other open spaces, or a lower heightof building, or a fewer number of stories, or a greater percentage of lot area to be leftunoccupied, or impose other and higher standards than are required by these Regulations,the provisions of such statute, bylaw, ordinance or regulation shall govern.6. Use of Land for Access: Access to any use in a nonresidential zoning district other than bya public street shall be prohibited on or across land in a residential zoning district.7. Yards and Open Space Required for Each Building: Except as otherwise provided herein,no part of any yard or other open space required around a building or structure shall beincluded as part of the yard or other open space required for any other building orstructure.8. Utilities: All utility and service lines shall be installed underground for any lot shown on anapproved subdivision or resubdivision plan for which a Building Permit has not been issuedas of the effective date of this regulation.19
