29-9.F8. Variancesa. Variances of the development regulations for floodplain areas may begranted by the ZBA provided that(1) Failure to grant the variance shall result in exceptionalhardship to the applicant;(2) The variance shall be the minimum necessary, considering theflood hazard, to afford relief; and(3) The variance shall not result in increased flood heights orthreats to public safety.b. Variances shall not be granted for any activity within the regulatedfloodway.c. Any applicant to whom a variance is granted shall be given writtennotice specifying the difference between the base flood elevation andthe elevation to which the structure is to be built. The applicant shallpay for the cost of obtaining this information if it is not available at theoffice of the Planning and Zoning Commission. Such notice shallstate that the cost of flood insurance will be commensurate with theincreased risk resulting from the reduced lowest floor elevation up toamounts as high as $25 for $100 of insurance coverage.*d. The local flood plain management administrator shall maintain therecords of all appeal actions and report any variances to the FederalEmergency Management Agency in its biennial report.*9. Other Permits and Licenses: Nothing in these Regulations shall remove anyindividual, firm or corporation from the responsibility of obtaining any otherpermit, license or authorization required by federal, State or local law orregulations.10. Disclaimer: The degree of flood protection required by these Regulationsis considered reasonable for regulatory purposes. Larger floods thanthose reflected by the base flood elevations referenced herein may occur,and flood heights may be increased by man-made or natural causes. Itshall also be recognized that land outside the regulated flood zones maybe subject to flooding and flood damage. These Regulations shall notcreate any liability on the part of the Town for any flood damage that mayresult from reliance upon these Regulations or any administrativedecisions lawfully made thereunder.G. SMOKE, DUST AND O<strong>THE</strong>R ATMOSPHERIC POLLUTANTS1. Method of Measurement of Smoke: For the purpose of grading the density of smoke, theRingelmann Smoke Chart shall be used to determine the total smoke units emitted. Areading shall be taken every minute for an hour, or, if less than an hour, until the total177
