29-1329-13 <strong>ZONING</strong> BOARD <strong>OF</strong> APPEALS (ZBA)A. POWERS AND DUTIES: The ZBA shall have all the powers and duties prescribed by Chapter124, Section 8 and by Chapter 250, Section 14 of the General Statutes, and by these Regulations,which powers and duties are summarized and more particularly specified below. None of thefollowing provisions shall be deemed to limit any of the authority of the ZBA that is conferred bygeneral law.1. Appeals: The ZBA shall have the authority to hear and decide upon any appeal where it isalleged that there is an error in the order, requirements, decision or determination of theZEO. No question of hardship shall be involved in such an appeal, and the action of theZBA thereon shall be limited to the question of whether or not, and to what extent suchorder, requirements, decision, or determination was a correct interpretation of the subjectprovision of these Regulations.2. Variances: The ZBA shall have the authority to vary or adjust the strict application of theseRegulations in only those cases where the unusual size, shape or topography of a lot orother unusual physical conditions pertaining to it or to any building situated thereon make itimpossible to strictly apply a specific provision of these Regulations to such lot withoutresulting in exceptional difficulty or unusual hardship, so that substantial justice shall bedone and the public health, safety and welfare secured.3. Location of Motor Vehicle Uses: The ZBA shall have the authority to hear and decide uponall requests for Certificates of Approval for motor vehicle sales, services and repair uses inaccordance with the General Statutes. Such authority shall not supersede theCommission's authority to hear and decide upon requests for Special Permits for suchuses.4. Use Variances: No use variance shall be granted by the ZBA including, but not limited to,a variance which would permit: *B. GENERAL RULESa. A use prohibited by these Regulations;b. The expansion of a non-conforming use;c. The number of dwelling units on a lot or in a building to exceed the maximumallowed in the zone in which the lot is located; ord. A use otherwise allowed by Special Permit in the district in which the use is located.Prior to a public hearing on any application for a use variance, the ZBA shall transmit theapplication to the Commission for its review and comment. Any report submitted by theCommission to the ZBA shall be read into the record of the public hearing of the subjectapplication.1. Appeals: All appeals to the ZBA from an order, requirement, decision or determination ofthe ZEO shall be taken within 30 days of the date of issuance of the order, requirement,decision or determination by the ZEO. Such appeals shall be made in writing on a form198
