29-1229-12 ADMINISTRATIONA. INTERPRETATION <strong>OF</strong> <strong>THE</strong>SE <strong>REGULATIONS</strong>: In their interpretation and application, theprovisions of these Regulations shall be held to be the minimum requirements adopted for thepromotion of the public health, safety, and welfare. These Regulations are not intended to repeal,abrogate, annul or in any way impair or interfere with any existing provisions of law or ordinance,or any rules, regulations, or permits previously adopted or issued or which shall be adopted orissued pursuant to law, relating to the use of lots, buildings or structures; nor are theseRegulations intended to interfere with, abrogate or annul any easements, covenants or otheragreement between parties, provided however, that where these Regulations impose a greaterrestriction upon the use or height of buildings or structures, or require larger yards, courts, or otheropen spaces than are imposed or required by existing provisions of law or ordinance, or by suchrules, regulations or permits, or by such easements, covenants or agreements, the provisions ofthese Regulations shall control.B. ENFORCEMENT: These Regulations shall be enforced by the ZEO who is hereby empowered tocause any buildings structures place or premises to be inspected and examined and to order inwriting the remedying of any condition found to exist therein or thereon in violation of anyprovisions of these Regulations or, when the violation involves grading or filling of land or theremoval of earth, to issue in writing a cease and desist order to be effective immediately.The owner or agent of a building or premises where a violation of any provision of theseRegulations has been committed or exists; or the lessee or tenant of an entire building or an entirepremises where such violation has been committed or exists; or the owner agent, lessee or tenantof any part of a building or premises in which such violation has been committed or exists, or theagent, architect, builder, contractor, or any other person who commits, takes part or assists in anysuch violation or who maintains any building or premises in which any such violation exists, shallbe subject to penalties in accordance with the provisions of Section 8-12 of the General Statutes.C. PENALTIES: Any person who: (1) having been served by the ZEO with an order to discontinueany such violation, fails to comply with such order within 10 days after such service; or, (2) havingbeen served with a cease and desist order with respect to a violation involving grading or filling ofland or removal of earth, fails to comply with such order immediately; or, (3) continues to violateany provision of these Regulations in the manner named in such order shall be subject topenalties in accordance with the provisions of Section 8-12 of the General Statutes, as amended.D. <strong>ZONING</strong> PERMITS1. Permit Required: No building or structure shall be erected, constructed, enlarged, alteredor moved, or excavation made therefor, or work begun thereon, or use made of any land orpremises, until a Zoning Permit therefor has been issued by the ZEO. A Zoning Permitshall be required in addition and prior to the issuance of a Building Permit. Except upon awritten authorization of the ZBA, under circumstances as set forth in 29-13, no ZoningPermit shall be issued for any building, structure or use which, when constructed, altered,expanded, moved or established, would be in violation of any of the provisions of theseRegulations. No Zoning Permit shall be issued for a use subject to Special Permit approvalor Site Plan approval, except in full accordance with all conditions and requirements ofsuch approvals.194
