Should the inspection ofany Tower reveal any structuraldefects that in the opinion of theindependent consultant rendersthe Tower unsafe, the followingaction shall be taken. Within 10business days of notification ofunsafe structure, the owner(s) ofthe Tower shall submit a plan toremediate the structuraldefect(s). This plan shall beinitiated within 10 days of thesubmission of the remediationplan, and completed as soon asreasonably possible. Failure toaccomplish this remediation ofstructural defect(s) within 10business days of initialnotification shall be a violation ofthe special permit and subject theowner(s) to penalties and finesas allowed under Federal, Stateand local laws and possibleremoval of structure.505. A contact person orcorporate department shall bedesignated in writing by theapplicant as the person tocontact regarding any mattersconcerning the proposed Facilityif and when constructed.Following construction, contactinformation shall be updatedannually, upon transfer or uponcompany merger or acquisition.The designation shall include at
29-4.D.least the name, address andtelephone number of thedesignated contact person andshall be included with theapplication and shall also bedisplayed on a sign mounted atthe entrance to the Facility. Thepurpose of this is to designatethe person to whom should bereported any electromagneticinterference with receptordevices on adjoining or nearbyproperties, with emergencyservices communications, anyviolations of these regulations, orany public safety and/oremergency conditions existing atthe site. The contact person shallreply in writing within 2 businessdays to the person making thecontact with a copy to the ZoningEnforcement Officer of the Townand shall take prompt actionappropriate to the nature of thereported condition.6. Removal and SiteRestoration: Removal and siterestoration shall be theresponsibility of the owner of theTower and/or the titleholder ofany non-publicly owned propertyon which the Tower is sited.7. A Licensed Carrier thatbuilds a new communicationsFacility will submit a letter to theTown committing that it willrespond positively to requestsfrom other Licensed Carriers toshare this Facility on reasonableterms51
