Article 12 Review ProceduresSection 12.04 <strong>Zoning</strong> Map Amendments (Rezonings)amendment is consistent with the adopted comprehensive plan, or inthe absence <strong>of</strong> such a finding, that one or more <strong>of</strong> the following apply:1. that the existing zoning classification given to the property isinappropriate, and that the proposed zoning classification isappropriate; and2. that there have been major changes <strong>of</strong> an economic, physical, orsocial nature in the area involved that were not anticipated inthe adopted comprehensive plan and that have substantiallyaltered the basic character <strong>of</strong> the area.B. Required findings must be in writing and be accompanied by a writtenreport that explicitly describes the reasons and substantiation for suchfindings. <strong>The</strong> findings and written report must be recorded in theminutes and records <strong>of</strong> the Planning Commission and the <strong>City</strong>Commission, as applicable.12.04.07 Notice to NKAPCPursuant to KRS 147.705, the <strong>City</strong> Commission must, within 60 days after adoption<strong>of</strong> any zoning ordinance or zoning map amendment, furnish a copy <strong>of</strong> the adoptedamendment to the Northern <strong>Kentucky</strong> Area Planning Commission.12.04.08 Changes/Amendments to Development PlansA. Minor Changes1. If the submittal <strong>of</strong> detailed engineering data was waived by the[Insert Official] in the initial submission <strong>of</strong> the developmentplan, then such data must be submitted for review in accordancewith the building permit procedures <strong>of</strong> Section 12.11 before apermit may be issued for construction.2. <strong>The</strong> [Insert Official], in reviewing the Stage I development plan,may authorize minor changes from the approved developmentplan, provided that the adjustments do not affect the spatialrelationship <strong>of</strong> structures, change land uses, increase overalldensity, alter circulation patterns (vehicular and pedestrian),decrease the amount or usability <strong>of</strong> open space or recreationareas, or permit activities that do not comply with this zoningordinance.B. AmendmentsAny amendments to approved Stage I development plans, except forthose minor adjustments which are permitted by the [Insert Official]as noted in Section 12.04.08A.2, must be resubmitted as new zoningmap applications.12.04.09 Concurrent Processing <strong>of</strong> Variances andConditional Use PermitsA. In accordance with KRS 100.203, an applicant, at the time <strong>of</strong> filing anapplication for a zoning map amendment, may elect to:1. have any necessary variances or conditional use permits for thesubject property be heard and finally decided by the Planning<strong>Covington</strong>, <strong>Kentucky</strong><strong>Zoning</strong> <strong>Ordinance</strong> Draft: 6/22/05Page 12-9
