Article 12 Review ProceduresSection 12.13 Designation of Historic Buildings and ZonesSection 12.13ZonesDesignation of Historic Buildings and12.13.01 applicabilityThe Urban Design Review Board must make a survey and study of the structuresand areas of the city and determine their historical or architectural merit of a degreewarranting their preservation as contributing or noncontributing structures indesignated historical areas. Persons from any organization or the general publicmay recommend a structure, area or site to the Urban Design Review Board forconsideration.12.13.02 applicationA. Applications for designation of historic structures, areas, and sitesmay be initiated by the owner of the subject property or the propertyowner’s authorized agent, or the Urban Design Review Board.B. Applications must be filed with the [Insert Official].12.13.03 Public Hearing noticeA. PublishedNotice of the time and place of all public hearings on the designationof historic structures, areas, and sites must be published at least oncein a newspaper of general circulation in the county. The requirednotice must appear in the newspaper aminimum of 15 calendar days before the publichearing.B. Mailed1. Records maintained by the Property Valuation Administratormay be relied upon conclusively to determine the identity andaddress of said owner. In the event such property is incondominium or cooperative forms of ownership, then theperson notified by mail must be the president or chairperson ofthe owner group which administers property commonly ownedby the condominium or cooperative owners. A joint notice maybe mailed to two or more co-owners of an adjoining propertywho are listed in the Property Valuation Administrator's recordsas having the same address.4. When any property in the required notification area for a publichearing on historic designation is located in an adjoining city,county or planning unit, notice of the hearing must be given atleast 15 days in advance of the hearing, by first class mail, to thefollowing public officials:(a) If the adjoining property is part of a planning unit, noticemust be given to that planning unit's PlanningCommission; or(b) If the adjoining property is not part of a planning unit,notice must be given to the mayor of the city in which theproperty is located or, if the property is in anunincorporated area, notice must be given to thejudge/executive of the county in which the property islocated.C. PostedNotice of all required public hearings on historic designations mustbe posted conspicuously on the subject property or in the proposedhistoric area for at least 15 calendar days prior to the public hearing.The posting must consist of one or more signs, constructed of durablematerial and clearly depicting the following information:1. the words “HISTORIC DESIGNATION” (three-inch highlettering);2. the date, place, and time of the public hearing (one-inch highlettering); and3. the address, including telephone number, where additionalinformation regarding the hearing may be obtained.12.13.04 urban design review board hearing/actionA. The Urban Design Review Board must hold at least one public hearingon all applications for designation of historic structures or areas.B. Following the Urban Design Review Board’s public hearing , it mustrecommend, by simple majority vote, approval of the list of structuresand areas selected as historic sites to the City Commission.
