Article 16 DefinitionsSection 16.02 Definitions <strong>of</strong> Words and Terms16.02.40 Concealed LightingAn artificial light source intended to illuminate the face <strong>of</strong> a sign, the direct source<strong>of</strong> which is shielded from public view and surrounding properties.16.02.41 Conditional UseA use which is essential to or would promote the public health, safety, or welfare inone or more zones, but which would impair the integrity and character <strong>of</strong> the zonein which it is located, or in adjoining zones, unless restrictions on location, size,extent, and character <strong>of</strong> performance are imposed in addition to those imposed inthis zoning ordinance.16.02.42 Conditional Use PermitLegal authorization to undertake a conditional use, issued by the [Insert Official],pursuant to authorization by the Board <strong>of</strong> Adjustment, consisting <strong>of</strong> two parts: (1) Astatement <strong>of</strong> the factual determination by the Board <strong>of</strong> Adjustment which justifiesthe issuance <strong>of</strong> the permit; and (2) A statement <strong>of</strong> the specific conditions whichmust be met in order for the use to be permitted.16.02.43 Conforming UseAny lawful use <strong>of</strong> a building, structure, lot, sign, or fence which complies with theprovisions <strong>of</strong> this zoning ordinance.16.02.44 Construction Sales and ServicesConstruction activities and incidental storage on lots other than construction sites.Also includes the retail or wholesale sale, from the premises, <strong>of</strong> materials used inthe construction <strong>of</strong> buildings or other structures other than retail sale <strong>of</strong> paint,fixtures, and hardware, but excludes those uses classified as “Vehicle Sales andService” use types. Typical uses include building materials stores, tool andequipment rental or sales and building contracting/construction <strong>of</strong>fices.16.02.45 Consumer RepairProvision <strong>of</strong> repair services to individuals and households, but not to firms.Excludes “Vehicle Sales and Service” use types. Typical uses include appliancerepair shops, locksmiths, shoe and apparel repair and musical instrument repair.16.02.46 Cultural Exhibits and LibrariesMuseum-like preservation and exhibition <strong>of</strong> objects in one or more <strong>of</strong> the arts andsciences, gallery exhibition <strong>of</strong> works <strong>of</strong> art, or library collection <strong>of</strong> books,manuscripts, etc., for study and reading.16.02.47 Curb CutAny interruption or break in the line <strong>of</strong> a street curb in order to provide vehicularaccess to a street.
