Article 13 Review and Decision-Making BodiesSection 13.03 Urban Design Review Boardmade by a [Insert Official] in the enforcement <strong>of</strong> this zoningordinance.C. To hear and decide applications for conditional use permits to allowthe proper integration into the community <strong>of</strong> uses which arespecifically named herein.D. To hear and decide, in accordance with the provisions <strong>of</strong> this zoningordinance and the adopted comprehensive plan, requests for thechange from one nonconforming use to another or the enlargement orextension <strong>of</strong> certain nonconforming uses, pursuant to KRS 100.253.13.02.04 DecisionsA. In exercising its powers and duties, the Board <strong>of</strong> Adjustment may, solong as such action is in conformity with the provisions <strong>of</strong> this zoningordinance, reverse or affirm wholly or partly, or may modify the order,requirements, decision, or determination as made by the [InsertOfficial], from whom the appeal is taken.B. A majority <strong>of</strong> Board <strong>of</strong> Adjustment members present and voting willbe necessary to reverse any order, requirement, decision ordetermination <strong>of</strong> the [Insert Official], so long as such action is inconformity with the provisions <strong>of</strong> this zoning ordinance; or to decidein favor <strong>of</strong> the applicant on any matter on which it is required to passunder this zoning ordinance; or to effect any variation in theapplication <strong>of</strong> this zoning ordinance.C. <strong>The</strong> details <strong>of</strong> the decision <strong>of</strong> the Board <strong>of</strong> Adjustment must beforwarded to the [Insert Official].Section 13.03Urban Design Review Board13.03.01 PurposeA. <strong>The</strong> Urban Design Review Board and the procedures for which it isresponsible for implementing are intended to promote theeducational, cultural, travel, industry, and other economic resourcesand the general welfare <strong>of</strong> the city by preserving and protecting theold, historic, or architecturally worthy structures, sites, monuments,streetscapes, squares, and neighborhoods, and the unique character <strong>of</strong>the Historic Area which imparts distinctiveness to the city and whichserves as visible reminders <strong>of</strong> the history and cultural heritage <strong>of</strong> thecity, the state, and the nation.B. <strong>The</strong> Urban Design Review Board is established for the purpose <strong>of</strong>stabilizing and improving property values in the Historic Area andencouraging new buildings and developments that will be harmoniouswith the existing historic buildings and districts but will notnecessarily be <strong>of</strong> the same architectural style. Regulations in suchareas are intended to protect against destruction <strong>of</strong> or encroachmentupon such areas, structures, or sites, to encourage uses which will leadto their continuance, conservation, and improvement in a mannerappropriate to the preservation <strong>of</strong> the cultural, social, economic,<strong>Covington</strong>, <strong>Kentucky</strong><strong>Zoning</strong> <strong>Ordinance</strong> Draft: 6/22/05Page 13-3
