Article 15 Penalties and EnforcementSection 15.03 Remedies and Enforcement PowersP. <strong>The</strong> <strong>City</strong> <strong>of</strong> <strong>Covington</strong> shall possess a lien on real property owned bythe person found by a final, non-appealable order <strong>of</strong> the CodeEnforcement Board, or by final judgment <strong>of</strong> the court, to havecommitted a violation <strong>of</strong> this zoning ordinance for all fines assessedfor the violation and for all charges and fees incurred by the <strong>City</strong> inconnection with the enforcement <strong>of</strong> this Code. <strong>The</strong> lien shall be noticeto all persons from the time <strong>of</strong> its recording and shall bear interest atthe legal rate until paid. <strong>The</strong> lien shall take precedence over all othersubsequent liens, except state, country, school board and city taxes,and may be enforced by judicial proceedings.Q. In addition to the remedy prescribed in subsection P above, theperson found to have committed the violation shall be personallyresponsible for the amount <strong>of</strong> all fines assessed for the violation andfor all charges and fees incurred by the <strong>City</strong> in connection with theenforcement <strong>of</strong> the ordinance. <strong>The</strong> <strong>City</strong> may bring a civil actionagainst the person and shall have the same remedies as provided forthe recovery <strong>of</strong> a debt.15.03.09 Penalties for violation <strong>of</strong> this zoning ordinanceA. Any person, firm, corporation, or entity that violates any provision <strong>of</strong>this subchapter shall be subject to a civil fine <strong>of</strong> not less than $100.00per day per violation but not more than $500.00 per day perviolation, or the cost to the <strong>City</strong> <strong>of</strong> <strong>Covington</strong> to abate the violation, orboth. Each date that a violation <strong>of</strong> this code continues after due noticehas been served in accordance with the terms <strong>of</strong> this Code shall bedeemed a separate <strong>of</strong>fense.B. <strong>The</strong> <strong>City</strong> <strong>of</strong> <strong>Covington</strong> shall possess a lien for all fines, penalties,charges, attorney’s fees and other reasonable costs associated withenforcing this code and placing <strong>of</strong> a lien on the parcel <strong>of</strong> real propertypursuant to this code. <strong>The</strong> lien shall be superior to and have priorityover all other subsequently filed liens, except state, county, schoolboard, and city taxes.15.03.10 Abatement <strong>of</strong> violation<strong>The</strong> imposition <strong>of</strong> the penalties herein prescribed shall not preclude the legal <strong>of</strong>ficer<strong>of</strong> the jurisdiction from instituting appropriate action to restrain, correct or abate aviolation, or to prevent illegal occupancy <strong>of</strong> a building, structure or premises, or tostop an illegal act, conduct, business, or utilization <strong>of</strong> the building, structure orpremises in violation <strong>of</strong> this zoning ordinance.<strong>Covington</strong>, <strong>Kentucky</strong><strong>Zoning</strong> <strong>Ordinance</strong> Draft: 6/22/05Page 15-7
