Article 12 Review ProceduresSection 12.10 <strong>Zoning</strong> PermitsCommission. All final actions which have not been appealed within30 days will not be subject to judicial review. <strong>The</strong> <strong>City</strong> Commissionmust be a party in any such appeal filed in the Circuit Court.D. After the appeal is taken, the procedure will be governed by the Rules<strong>of</strong> Civil Procedure. When an appeal has been filed, the Clerk <strong>of</strong> theCircuit Court must issue a summons to all parties and cause it to bedelivered for service as in any other law action.E. <strong>The</strong> owner <strong>of</strong> the subject property and applicants who initiated theproceeding will be made parties to the appeal. Other persons speakingat the public hearing are not required to be made parties to suchappeal.F. For purposes <strong>of</strong> this zoning ordinance, final action will be deemed tohave occurred on the calendar date when the vote is taken to approveor disapprove the matter pending before the body.G. <strong>The</strong> computation <strong>of</strong> the 30-day timeframe must be in accordance withKRS 446.030.12.09.05 Stay <strong>of</strong> ProceedingsAn appeal stays all proceedings in furtherance <strong>of</strong> the action appealed , unless the[Insert Official] from whom the appeal is taken certifies to the Board <strong>of</strong> Adjustment,after the notice <strong>of</strong> appeal is filed with him or her, that by reason <strong>of</strong> facts stated inthe certificate, a stay would, in his or her opinion, cause imminent peril to lifeand/or property. In such case, proceedings may not be stayed other than by a court<strong>of</strong> record on the application, or on notice to the [Insert Official] from whom theappeal is taken and on due cause shown.Section 12.10<strong>Zoning</strong> Permits12.10.01 ApplicabilityA. No land may be used and no building or other structure may beerected, moved, added to, structurally altered, or changed from onepermitted use to another, nor may any grading take place on any lot orparcel <strong>of</strong> ground without a permit issued by the [Insert Official].B. A zoning permit is also required before the demolition <strong>of</strong> any structureor portion there<strong>of</strong>, and prior to issuance <strong>of</strong> a certificate <strong>of</strong> occupancy.12.10.02 ApplicationA. An application for a zoning permit must be filed by the owner <strong>of</strong> thesubject property or the property owner’s authorized agent.B. Applications must be filed with the [Insert Official].C. Contents1. <strong>The</strong> required fee for a zoning permit.2.
