Article 12 Review ProceduresSection 12.05 Planned Unit Developments (PUDs)application to the <strong>City</strong> Commission without a recommendationdue to a tie vote.4. Unless a simple majority <strong>of</strong> the entire <strong>City</strong> Commission votes tooverride the Planning Commission's recommendation, thePlanning Commission’s recommendation will become final andeffective, and if a recommendation <strong>of</strong> approval or approval withconditions was made by the Planning Commission, theordinance <strong>of</strong> the <strong>City</strong> Commission adopting the PUD zoning mapamendment will be deemed to have passed by operation <strong>of</strong> law.5. <strong>The</strong> action <strong>of</strong> the <strong>City</strong> Commission may incorporate anyconditions imposed by the Planning Commission. However,should the <strong>City</strong> Commission take action to impose differentconditions than those recommended by the PlanningCommission, then the conditions must be resubmitted to thePlanning Commission for further review and recommendationin accordance with Sec. 12.05.02C.6. <strong>The</strong> <strong>City</strong> Commission must forward a copy <strong>of</strong> the approved StageI development plan to the Planning Commission for furtherprocessing in accordance with the requirement for Stage II planand record plat (See 12.05.03).E. Effect <strong>of</strong> Approval1. Approval <strong>of</strong> a PUD zoning map amendment and Stage Idevelopment plan authorizes the applicant to proceed to thesecond stage <strong>of</strong> the PUD approval process.2. <strong>The</strong> PUD zoning map amendment will not become effective untila Stage II plan and record plat has been approved in accordancewith Sec. 12.05.03. Upon the effective date <strong>of</strong> the PUD zoningmap amendment, the <strong>of</strong>ficial zoning map must be amended byadding the prefix “PUD” to the existing zoning map designationfor the subject property (e.g., PUD-RS-12.5).12.05.03 Stage II—Stage II Plan and Record Plat<strong>The</strong> second stage <strong>of</strong> the PUD approval process requires review and approval <strong>of</strong> aStage II plan and record plat.A. ApplicationFollowing approval <strong>of</strong> the PUD zoning map amendment and Stage Idevelopment plan, a Stage II plan and record plat must be developedin conformance with the approved Stage I plan.1. An application for approval <strong>of</strong> a Stage II plan and record platmust be filed by the owner <strong>of</strong> the subject property or theproperty owner’s authorized agent.2. <strong>The</strong> [Insert Official] must sign and the applicant must submitthe application to the Kenton County Planning Commission, orits duly authorized representative.3.
