Article 5 Overlay ZonesSection 5.03 HP-O, Historic Preservation Overlay5.03.06 Special conditionsA. Off-street parking, as set forth in Article 7.B. No alteration or remodeling is permitted that will deface or destroythe general exterior architectural features or design that this chapteris attempting to preserve.C. No demolition <strong>of</strong> buildings or structures is permitted in this historicpreservation overlay zone unless reviewed and approved by the<strong>Zoning</strong> Administrative Official, the Building Commissioner, and theUrban Design Review Board.D. No construction will be permitted that is incompatible with thebalance <strong>of</strong> the architectural design in the historical zone.5.03.07 Protective Maintenance RequiredA. All contributing buildings and structures in designated historical areasmust be properly maintained and repaired at the same level requiredelsewhere in the city. Should an owner omit essential maintenanceand repairs, which would eventually result in the building becomingso run down that it would be constitutionally unreasonable for the cityto refuse to allow the owner to demolish the building, the UrbanDesign Review Board must bring this matter to the attention <strong>of</strong> theBuilding Inspector who must immediately require <strong>of</strong> the owner oragent protective maintenance and repair to further the economy,health, safety, and general welfare <strong>of</strong> the city and nothing in thissubchapter will be construed to prevent ordinary maintenance orrepairs <strong>of</strong> any structures.B. In any case where the Building Inspector determines that there areemergency conditions dangerous to life, health, or property affecting ahistoric structure or area, he or she may order the remedy <strong>of</strong> theseconditions without the approval <strong>of</strong> the Urban Design Review Board.<strong>The</strong> Building Inspector must promptly notify the Chairperson <strong>of</strong> theUrban Design Review Board <strong>of</strong> the action being taken.5.03.08 Actions by the <strong>City</strong> CommissionA. If the <strong>City</strong> Commission creates a historic overlay zone, its action mustinclude a declaration that the landmarks, buildings, structures, orsites to be preserved are in fact <strong>of</strong> historical or architecturalsignificance requiring protection against destruction andencroachment; that the designation <strong>of</strong> individual structures andpremises <strong>of</strong> substantial public interest and <strong>of</strong> structures, premises, oruses likely to have an adverse effect must be used as an administrativeguide.B. It is also the intent <strong>of</strong> this section that the <strong>City</strong> Commission be lenientin its judgment <strong>of</strong> plans for new construction or for alteration, repair,or demolition <strong>of</strong> structures <strong>of</strong> little historic value not shown onpriority lists, except where such construction, alteration, repair, ordemolition would seriously impair the historic or architectural value<strong>of</strong> surrounding structure or the surrounding area.
