Article 5 Overlay ZonesSection 5.04 AP-O, Area Protection OverlayF. <strong>The</strong> zoning map amendment to remove the AP Overlay zonedesignation must be in accordance with the procedures outlined inKRS Chapter 100 for a zoning map amendment. Additionally, anyamendment for removal <strong>of</strong> the AP Overlay zone designation made inconjunction with the adoption <strong>of</strong> a development plan project (KRSChapter 99) must include as part <strong>of</strong> the amendment that theindication be made on the <strong>of</strong>ficial zoning map that a developmentplan project is in effect in the area.5.04.03 Permitted developmentA. Permitted usesBuildings or premises may be utilized only for those permitted orconditional uses within the particular underlying zone where thebuilding or premises is located, and provided that no newconstruction is permitted except in accordance with the requirements<strong>of</strong> this section. Conditional uses must also be reviewed and approvedby the city's Board <strong>of</strong> Adjustment.B. New constructionNew construction means demolition, erection, physical expansion, oroutside remodeling <strong>of</strong> building or premises, including accessory usesor appurtenances to the principal use. It does not mean normalmaintenance (such as cleaning and painting) nor demolition requiredby the Department <strong>of</strong> Housing and Code Enforcement for thepurposes <strong>of</strong> maintaining the health, safety, and welfare <strong>of</strong> theneighborhood.1. ApplicationA permit for new construction may be granted only inaccordance with the following review process:(a) Applicable information as required under Section 12.06must be submitted to the [Insert Official] for acceptanceand further processing. In addition, architectural drawingsor renderings <strong>of</strong> various elevations must be included toidentify outside building treatment. <strong>The</strong> purpose <strong>of</strong> thematerial submitted is to determine the compliance <strong>of</strong> theproposed new construction with the identified reviewcriteria in paragraph 5.04.03B.2.(b) <strong>The</strong> [Insert Official] must review the submittedinformation within 30 days <strong>of</strong> its receipt to determine ifthe proposed new construction is in compliance with thezoning ordinance (such as use, parking, and setbacks). <strong>The</strong>[Insert Official] must then submit, with the proposal fornew construction, a report to the Urban Design ReviewBoard identifying whether or not the proposal is incompliance with the requirements <strong>of</strong> the zoning ordinanceand if not in compliance, what must be done to complywith this chapter (such as additional parking or setback orvariance from the Board <strong>of</strong> Adjustment).<strong>Covington</strong>, <strong>Kentucky</strong><strong>Zoning</strong> <strong>Ordinance</strong> Draft: 6/22/05Page 5-9
