Article 5 Overlay ZonesSection 5.05 P-O, Phased Overlay(b) Goals and objectives for the area<strong>The</strong> proposed new construction must be consistent withthe adopted goals and objectives for future developmentwithin the area as noted by the city in identifying the areafor consideration as a development plan project under KRSChapter 99.(c) HeightNew buildings, including all appurtenances thereto, mustbe constructed so as to maintain a relationship compatibleto and in character with existing adjacent developmentalong or within the same block. Consideration must begiven to maintaining similar building proportions (heightto width) as exists within the area. Where necessary, theUrban Design Review Board may recommend a variance berequested from the Board <strong>of</strong> Adjustment. Anyrecommendation by the Urban Design Review Board forapproval <strong>of</strong> a new construction proposal that requires avariance from the Board <strong>of</strong> Adjustment must beconditioned on receipt <strong>of</strong> the variance.(d) LocationNew buildings must be positioned so as to maintain theexisting pattern <strong>of</strong> setback from the street and theestablished building rhythm (structure to open space)where applicable. Where necessary, the Urban DesignReview Board may recommend a variance be requestedfrom the Board <strong>of</strong> Adjustment. Any recommendation bythe Urban Design Review Board for approval <strong>of</strong> newconstruction proposal that requires a variance from theBoard <strong>of</strong> Adjustment must be conditioned on receipt <strong>of</strong> thevariance.(e) Special detailsArchitectural details including windows, doors, ro<strong>of</strong>ing,and facade treatments on new and remodeled buildingsmust be in character with existing structures the area interms <strong>of</strong> sizes, shapes and materials.5.04.04 Other regulations<strong>The</strong> amendment <strong>of</strong> AP Overlay zone does not affect the applicability <strong>of</strong> otherregulations contained within this chapter.Section 5.05 P-O, Phased Overlay5.05.01 PurposePhased zoning is an overlay type regulation to be used in cases where the time orphasing <strong>of</strong> the zoning <strong>of</strong> an area is especially critical to the implementation <strong>of</strong> theadopted comprehensive plan. <strong>The</strong> intent <strong>of</strong> the phased zoning regulations is toencourage redevelopment <strong>of</strong> a specified area for the use or density designated onthe comprehensive plan when the necessary conditions for such development arerealized (for example, demolition <strong>of</strong> existing building).
