Section 15.02Article 15 Penalties and EnforcementSection 15.02 Activities Constituting ViolationsActivities Constituting ViolationsUnless otherwise expressly stated by this zoning ordinance or state law, any violation ofthis zoning ordinance, including but not limited to the following, will be subject to theremedies and penalties provided for in this article:15.02.01 to use land or buildings in any way not consistent with therequirements of this zoning ordinance;15.02.02 to engage in development activity in any way not consistent with therequirements of this zoning ordinance.15.02.03 to install or use a sign in any way not consistent with the requirementsof this zoning ordinance.15.02.04 to engage in the use of a building or land, the use or installation of asign, or development activity requiring one or more permits or approvals underthis zoning ordinance without obtaining all such required permits or approvals;15.02.05 to engage in the use of a building or land, the use or installation of asign, or development activity requiring one or more permits under this zoningordinance in any way inconsistent with any such permit or approval or anyconditions imposed thereon;15.02.06 to violate the terms of any permit or approval granted under thiszoning ordinance or any condition imposed on such permit or approval;15.02.07 to obscure, obstruct or destroy any notice required to be posted orotherwise given under this zoning ordinance; or15.02.08 to violate any lawful order issued by any person or entity under thiszoning ordinance.Section 15.03Remedies and Enforcement PowersThe zoning enforcement officer may use any of the remedies and enforcement powers setforth in this section.15.03.01 Withhold Permits and ApprovalsThe zoning enforcement officer will deny or withhold all permits, certificates orother forms of authorization on any land, or structure or improvements thereon:A. upon which there is an uncorrected violation of a provision of thiszoning ordinance or of a condition or qualification of a permit,certificate, approval or other authorization previously granted by thecity; andB. owned or being developed by a person who owns, developed orotherwise caused an uncorrected violation of a provision of thiszoning ordinance or of a condition or qualification of a permit,certificate, approval or other authorization previously granted by thecity.15.03.02 Approval of PermitsInstead of withholding or denying a permit or other authorization, the official withauthority to approve the permit or authorization may grant such authorization ifadequate assurances are in place to ensure correction of the violation and providedCovington, KentuckyZoning Ordinance Draft: 6/22/05Page 15-2
Article 15 Penalties and EnforcementSection 15.03 Remedies and Enforcement Powersthat granting the permit or authorization will not compromise the public health,safety or general welfare.15.03.03 Revoke Permits and ApprovalsA. Any permit or other form of authorization required under this zoningordinance may be revoked by the zoning enforcement officer or by anyofficial with authority to issue such permit when the zoningenforcement officer or other authorized official determines: (1) thatthere is departure from the plans, specifications, or conditions asrequired under terms of the permit, (2) that the development permitwas procured by false representation or was issued by mistake, or (3)that any of the provisions of this zoning ordinance are being violated.B. Where permits are mistakenly issued, an applicant will be entitled toappeal the permit revocation to the Board of Adjustment.C. The [Insert Official] is authorized to issue or post, in a prominentlocation, a notice of revocation and order requiring the use orconstruction to stop immediately. Upon receipt of the notice ofrevocation, the property owner or his authorized agent, or the user oroccupant of the property must immediately stop the use or activity.15.03.04 Stop WorkA. Whenever a building or part thereof is being constructed,reconstructed, altered or repaired or any other work is beingconducted in violation of this zoning ordinance, the zoningenforcement officer may order the work to be immediately stopped.B. The stop-work order must be in writing and directed to the persondoing the work. The stop-work order must state the specific work tobe stopped, the specific reasons for the stoppage, and the conditionsunder which the work may be resumed.C. Violation of a stop-work order constitutes a misdemeanor.15.03.05 Revoke Plans or Related ApprovalsWhere a violation of this zoning ordinance involves a failure to comply withapproved plans, or conditions to which the approval of such plans was madesubject, the city may, upon notice to the applicant and other known parties ininterest (including any holders of building permits affected), revoke the plan orother approval or condition its continuance on strict compliance with this zoningordinance, the provision of financial security to ensure that construction iscompleted in compliance with approved plans, or such other conditions as the Citymay reasonably impose. Any required financial security must be in a form approvedby the city.15.03.06 Forfeiture and Confiscation of SignsAny sign installed or placed on public property, except in full compliance with theregulations of Article 10, will be subject to forfeiture to the city and to confiscation.In addition to other remedies and penalties of this section, the city has the right torecover from the sign owner or person who placed the sign, the full costs of signremoval and disposal.Covington, KentuckyZoning Ordinance Draft: 6/22/05Page 15-3
