Article 12 Review ProceduresSection 12.09 AppealsB. mailed<strong>The</strong> Board <strong>of</strong> Adjustment must give written notice to the appellant,the administrative <strong>of</strong>ficial whose action is the subject <strong>of</strong> the appeal,and all parties <strong>of</strong> record at least one calendar week prior to thehearing. Board <strong>of</strong> Adjustment ActionC. <strong>The</strong> Board <strong>of</strong> Adjustment must fix a reasonable time for hearing theappeal and decide on the appeal within 60 calendar days. <strong>The</strong>affected party may appear at the hearing in person or by attorney.D. At the public hearing held by the Board <strong>of</strong> Adjustment, any interestedperson may appear and enter his appearance, and all must be given anopportunity to be heard.E. Pursuant to KRS 147.705, within 60 days <strong>of</strong> the decision, the Board <strong>of</strong>Adjustment must furnish or cause to be furnished, its decision onappeals <strong>of</strong> decisions to the Northern <strong>Kentucky</strong> Area PlanningCommission.12.09.04 Appeals <strong>of</strong> Planning Commission, Board <strong>of</strong>Adjustment or <strong>City</strong> Commission DecisionsAny appeal from the Planning Commission, Board <strong>of</strong> Adjustment or <strong>City</strong>Commission action may be taken in the following manner:A. Any person or entity claiming to be injured or aggrieved by any finalaction <strong>of</strong> the Board <strong>of</strong> Adjustment may appeal the action to the CircuitCourt <strong>of</strong> the county in which the property which is the subject <strong>of</strong> theaction lies. Such appeal must be taken within 30 days after the finalaction <strong>of</strong> the Board <strong>of</strong> Adjustment. All final actions which have notbeen appealed within 30 days will not be subject to judicial review.<strong>The</strong> Board <strong>of</strong> Adjustment must be a party in any such appeal filed inthe Circuit Court.B. Any person or entity claiming to be injured or aggrieved by any finalaction <strong>of</strong> the Planning Commission may appeal the action to theCircuit Court <strong>of</strong> the county in which the property, which is the subject<strong>of</strong> the action, lies. Only Planning Commission final actions grantingor denying variances or conditional use permits that were processedconcurrently with a map amendment in accordance with Section12.04.09, may be appealed pursuant to this subsection. PlanningCommission recommendations made to other governmental bodiesmay not be appealed. <strong>The</strong> appeal must be taken within 30 days afterthe final action. <strong>The</strong> 30-day timeframe for taking an appeal begins torun at the time the <strong>City</strong> Commission grants or denies the mapamendment for the same development. All final actions which havenot been appealed within 30 days will not be subject to judicialreview. <strong>The</strong> Planning Commission must be a party in any such appealfiled in the Circuit Court.C. Any person or entity claiming to be injured or aggrieved by any finalaction <strong>of</strong> the <strong>City</strong> Commission on a map amendment may take anappeal from the action to the Circuit Court <strong>of</strong> the county in which theproperty, which is the subject <strong>of</strong> the map amendment, lies.
