Article 12 Review ProceduresSection 12.06 Stage I Development Plan Review12.05.04 AmendmentsAny amendments to plans, except for minor deviations that are permitted by thePlanning Commission, or its duly authorized representative, must be made inaccordance with the procedure required by this section, subject to the samelimitations and requirements as those under which the plans were originallyapproved.12.05.05 ExpirationAny amendment to the PUD Overlay zone is subject to the time constraints notedbelow. On expiration <strong>of</strong> the time period and any extensions thereto, the legislativebody may initiate a request for a public hearing by the Planning Commission inaccordance with the requirements <strong>of</strong> KRS Chapter 100 for the purpose <strong>of</strong>determining whether the PUD Overlay zone should revert to its original zoningdesignation. A public hearing may be initiated if either <strong>of</strong> the following conditionsapplies:A. A Stage II Plan has not been approved by the Planning Commission,or its duly authorized representative, within 24 days <strong>of</strong> the date <strong>of</strong> theStage I plan approval and overlay zone amendment by the <strong>City</strong>Commission. <strong>The</strong> <strong>City</strong> Commission is authorized to grant anextension <strong>of</strong> time if they determine, based on evidence provided bythe applicant, that prevailing conditions have not changed appreciablyto render the Stage I approved plan obsolete.B. Substantial construction has not been initiated within a period <strong>of</strong> 12consecutive months from the date <strong>of</strong> approval <strong>of</strong> the Stage II plan bythe Planning Commission, or its duly authorized representative. <strong>The</strong><strong>City</strong> Commission is authorized to grant an extension <strong>of</strong> time if theydetermine, based on evidence provided by the applicant, thatconstruction was delayed due to circumstances beyond the applicant'scontrol and that prevailing conditions have not changed appreciablyto render the Stage I approved plan obsolete. <strong>The</strong> amount <strong>of</strong>construction that constitutes initiating substantial construction mustbe as approved in the Stage II approved plan.Section 12.06Stage I Development Plan Review12.06.01 applicabilityA Stage I development plan must accompany all applications for zoning mapamendments in any Commercial (C), Industrial (I), or RU-2B, RU-1, and RU-0.5zoning classification, except for single- or two-unit dwellings, and all applicationsfor planned unit developments.12.06.02 application<strong>The</strong> Stage I Plan must be drawn to a scale not smaller than one inch equals 100 feetand include on the plan or in accompanying documentation the followinginformation:A. <strong>The</strong> total area in the project;B. <strong>The</strong> present zoning <strong>of</strong> the subject property and all adjacent properties;<strong>Covington</strong>, <strong>Kentucky</strong><strong>Zoning</strong> <strong>Ordinance</strong> Draft: 6/22/05Page 12-16
