SCOPING AND CONSULTATION
Submission of Request for Scoping Opinion
3.10 The initial „Request for a Scoping Opinion‟, on the wind farm proposal was
submitted to RMBC in May 2008. The request for a Scoping Opinion was
made under Regulation 10 of the Town and Country Planning
(Environmental Impact Assessment) (England and Wales) Regulations
1999, under which developers may request an opinion from the
determining authority, on the information that should be supplied within the
ES.
3.11 The Applicant‟s scoping report stated that the following topic areas would
most likely give rise to potentially significant effects:
Landscape and visual;
Archaeology and cultural heritage;
Residential amenity (noise and shadow flicker); and
Ecology and ornithology.
3.12 The following were also outlined as secondary issues that would be
discussed in the ES:
Traffic and transport;
Radio-communications, television and aeronautical Issues;
Ground conditions and surface drainage;
Safety; and
Cumulative effects.
The Local Planning Authority’s Scoping Opinion
3.13 The Local Planning Authority‟s formal response in the form of a Scoping
Opinion made in accordance with Regulation 10, sets out its opinion as to
the information that should be included within the ES. A draft Scoping
Opinion was issued by RMBC on 3 rd September 2008, with the final
Scoping Opinion dated 24 th September 2008. The key points identified
within the scoping response, together with details on where these points
are covered within the ES and application documentation, are set out
under the following headings:
Landscape & Visual: (including cumulative effects) considered in
Section 6 of the ES;
