APPENDIX ASTATE LAWS RELATED TO AIRPORT LAND USE PLANNING21673. Initiation of Proceedings for Creation by Owner of <strong>Airport</strong>In any county not having a commission or a body designated to carry out the responsibilities of acommission, any owner of a public airport may initiate proceedings for the creation of a commission bypresenting a request to the board of supervisors that a commission be created and showing the needtherefore to the satisfaction of the board of supervisors.21674. Powers and DutiesThe commission has the following powers and duties, subject to the limitations upon its jurisdiction setforth in Section 21676:(a) To assist local agencies in ensuring compatible land uses in the vicinity of all new airports and in thevicinity of existing airports to the extent that the land in the vicinity of those airports is not alreadydevoted to incompatible uses.(b) To coordinate planning at the state, regional, and local levels so as to provide for the orderlydevelopment of air transportation, while at the same time protecting the public health, safety, andwelfare.(c) To prepare and adopt an airport land use compatibility plan pursuant to Section 21675.(d) To review the plans, regulations, and other actions of local agencies and airport operators pursuant toSection 21676.(e) The powers of the commission shall in no way be construed to give the commission jurisdiction overthe operation of any airport.(f) In order to carry out its responsibilities, the commission may adopt rules and regulations consistentwith this article.21674.5. Training of <strong>Airport</strong> <strong>Land</strong> <strong>Use</strong> Commission’s Staff(a) The Department of Transportation shall develop and implement a program or programs to assist inthe training and development of the staff of airport land use commissions, after consulting withairport land use commissions, cities, counties, and other appropriate public entities.(b) The training and development program or programs are intended to assist the staff of airport land usecommissions in addressing high priority needs, and may include, but need not be limited to, thefollowing:(1) The establishment of a process for the development and adoption of airport land usecompatibility plans.(2) The development of criteria for determining the airport influence area.A–9<strong>Brown</strong> <strong>Field</strong> <strong>Municipal</strong> <strong>Airport</strong> <strong>Land</strong> <strong>Use</strong> <strong>Compatibility</strong> <strong>Plan</strong>January 25, 2010
