CHAPTER 2AIRPORT LAND USE COMMISSION POLICIES2.4.3 Airport Impacts Not Considered: Other impacts sometimes created by airports (e.g., air pollutionor automobile traffic) are not addressed by these compatibility policies and are not subject toALUC review. Also, in accordance with state law (Pub. Util. Code §21674(e)), neither thisCompatibility Plan nor the ALUC have authority over the operation of the Airport (e.g., whereand when aircraft fly or airport security).2.5 GEOGRAPHIC SCOPEThe geographic scope of this Compatibility Plan is established though an AIA delineated as follows:2.5.1 The AIA for the Airport is the area in which current and projected future airport-related noise,safety, airspace protection, or overflight factors/layers may significantly affect land use ornecessitate restrictions on land use. The AIA is presented on Exhibit III-5 in Chapter 3 of thisCompatibility Plan.2.5.2 The AIA for the Airport is divided into two subareas, Review Area 1 and Review Area 2.Descriptions of each area and the basis for their delineation are provided in Chapter 3.2.6 TYPES OF ACTIONS REVIEWED2.6.1 Actions that Always Require ALUC Review: As required by state law, even if a local agency’sgeneral plan is consistent with the current compatibility plan, the following types of actions shallbe referred to the ALUC for determination of consistency with this Compatibility Plan prior totheir approval by the local agency:(a) The adoption, approval or amendment of any general plan (Pub. Util. Code §21676(b))that affects lands within the AIA and involves:(1) Noise or safety concerns within Review Area 1; or(2) Land use actions that have been determined to be a hazard by the FAA in accordancewith Part 77 within Review Areas 1 and 2.(b) Adoption or modification of the airport master plan for the Airport (Pub. Util. Code§21676(c)).(c) Any proposal for expansion of the Airport if such expansion will require an amendedAirport Permit from the State of California (Pub. Util. Util Code §21661.5).2.6.2 Other Land Use Actions Subject to ALUC Review: Other types of land use actions are subject toreview under these circumstances:(a) Until such time as the ALUC finds that a local agency’s general plan is consistent with thisCompatibility Plan, or the local agency has overruled the ALUC’s determination ofinconsistency, state law allows ALUCs to require that local agencies submit all land useactions involving land within an AIA to the ALUC for review (Pub. Util. Code§21676.5(a)). Only those actions that an ALUC elects not to review are exempt from thisrequirement.(1) Within Review Area 1, all land use actions are subject to ALUC review, except asprovided in Section 2.6.3.(2) Within Review Area 2, only the following land use actions require ALUC review:(i) Any object which has received a final notice of determination from the FAA thatthe project will constitute a hazard or obstruction to air navigation, to the extentapplicable.(ii) Any proposed object in a High Terrain Zone or in an area of terrain penetrationto airspace surfaces which has a height greater than 35 feet above ground level.(iii) Any project having the potential to create electrical or visual hazards to aircraftin flight, including: electrical interference with radio communications or navigationalsignals; lighting which could be mistaken for airport lighting; glare or bright lights(including laser lights) in the eyes of pilots or aircraft using the Airport; certain colors ofneon lights- especially red and white- that can interfere with night vision goggles; andimpaired visibility near the Airport. The local agency should coordinate with the airportoperator in making this determination.(iv) Any project having the potential to cause an increase in the attraction of birds orother wildlife that can be hazardous to aircraft operations in the vicinity of the Airport.The local agency should coordinate with the airport operator in making this decision.(3) On Airport property, proposed nonaviation development shall also be subject to ALUCreview (see Section 2.2 for definition of aviation-related use).(4) Any project located in the runway protection zone.(b) After a local agency has revised its general plan to be consistent with this CompatibilityPlan or has overruled the ALUC’s Compatibility Plan, the ALUC no longer has authorityunder state law to require that all land use actions be submitted for review.
