CHAPTER 2AIRPORT LAND USE COMMISSION POLICIESagree that the ALUC should continue to review and comment upon individual projects(Pub. Util. Code §21676.5(b)). Because the ALUC reviews are discretionary and advisoryunder these circumstances, local agencies are not required to adhere to the overrulingprocess if they elect to approve a project without incorporating design changes orconditions recommended by the ALUC.(c) Proposed redevelopment of property for which the existing land use is consistent with thegeneral plan (including a general plan that has been reviewed by the ALUC and found tobe consistent with this <strong>Compatibility</strong> <strong>Plan</strong> or a prior compatibility plan for the <strong>Airport</strong>), butnonconforming with the compatibility criteria set forth in this <strong>Compatibility</strong> <strong>Plan</strong>, shall besubject to ALUC review. This policy is intended to address circumstances that arise whena general plan land use designation does not conform to ALUC compatibility criteria, butis deemed consistent with this <strong>Compatibility</strong> <strong>Plan</strong> because the designation reflects anexisting land use. Proposed redevelopment of such land voids the consistency status and isto be treated as new development subject to ALUC review even if the proposed use isconsistent with the local general plan (also see Policies 2.3.2, 2.11.2 and 2.11.3).2.6.3 <strong>Land</strong> <strong>Use</strong> Actions Subject to Discretionary ALUC Staff Review: ALUC staff has the authorityand discretion to make a consistency determination without formal ALUC review of the project ifthe land use action:(a) Is “compatible” with both noise and safety compatibility policies; and(b) Has received a final notice of determination from the FAA that the project will not constitutea hazard or obstruction to air navigation, to the extent applicable; and(c) Has been conditioned by the local agency to require an overflight notification consistent withthe requirements of Policy 3.6.3, to the extent applicable.2.7 GENERAL REVIEW PROCESS FOR LAND USE ACTIONS2.7.1 Timing of Project Submittal: The precise timing of ALUC review of a proposed land use actionmay vary depending upon the nature of the project.(a) General plans and projects should be referred to the ALUC at the earliest reasonable timeso that the ALUC’s review can be duly considered by the local agency before formalizingits actions.
