APPENDIX ASTATE LAWS RELATED TO AIRPORT LAND USE PLANNINGstate agency or officer shall grant, apportion, or allow to such community college district forexpenditure in connection with that site, any state funds otherwise made available under any statelaw whatever for a community college site acquisition or college building construction, or forexpansion of existing sites and buildings, and no funds of the community college district or of thecounty in which the district lies shall be expended for such purposes; provided that provisions of thissection shall not be applicable to sites acquired prior to January 1, 1966, nor any additions orextensions to such sites.If the recommendations of the Division of Aeronautics are unfavorable, such recommendations shallnot be overruled without the express approval of the board of governors and the State AllocationBoard.A–44Brown Field Municipal Airport Land Use Compatibility PlanJanuary 25, 2010

Airport Planning(a) If a lead agency prepares an environmental impact report for a project situated within airportcomprehensive land use plan boundaries, or, if a comprehensive land use plan has not been adopted,for a project within two nautical miles of a public airport or public use airport, the Airport Land UsePlanning Handbook published by the Division of Aeronautics of the Department of Transportation,in compliance with Section 21674.5 of the Public Utilities Code and other documents, shall beutilized as technical resources to assist in the preparation of the environmental impact report as thereport relates to airport-related safety hazards and noise problems.(b) A lead agency shall not adopt a negative declaration for a project described in subdivision (a) unlessthe lead agency considers whether the project will result in a safety hazard or noise problem forpersons using the airport or for persons residing or working in the project area.A–45Brown Field Municipal Airport Land Use Compatibility PlanJanuary 25, 2010
