But, in <strong>the</strong>absence <strong>of</strong> legal documents, it is very unlikelythat emphasis on legal identity would reduceexclusion. 52 Accordingly, <strong>the</strong> challenge to comprehensivelyaddress <strong>the</strong> inter-related components<strong>of</strong> <strong>the</strong> continuum from <strong>the</strong> informal to <strong>the</strong> formalend <strong>of</strong> <strong>the</strong> economy is not technological; it is instructuring institutions, capacities, incentivesand regulations to provide certainty to economicexchange and <strong>the</strong>refore to equitable economicgrowth. 53issues highlighted in this section, which also providedan overview <strong>of</strong> informal economies around<strong>the</strong> globe. The next section on legal identity andbusiness rights discusses, among o<strong>the</strong>r issues,<strong>the</strong> need for an effective enabling environment,regulatory regime, commercial law and good economicgovernance that is required for businessto operate with equitable economic rights andwith guarantees <strong>of</strong> greater accountability in <strong>the</strong>government’s ability to issue laws with <strong>the</strong> capacityto implement and enforce <strong>the</strong>m.Economic growth draws upon activities that arecomplex, fluid and geographically dispersed. Theyrequire an elaborate and ever evolving division <strong>of</strong>labour ranging from owners <strong>of</strong> formal and informalenterprises, producers, managers, and <strong>the</strong>iremployees, who are an integral component <strong>of</strong> <strong>the</strong>value chain. Such a large-scale division <strong>of</strong> labourrequires state-like institutions for public enforcement<strong>of</strong> laws and contracts 54 and for its efficientsustainability. Although <strong>the</strong> government takes <strong>the</strong>lead in creating regulations, it is important to engageo<strong>the</strong>r stakeholders, including <strong>the</strong> poor peopleas economic actors, as well as NGOs, localpublic governance structures, and informal labourassociations. This would ensure ownership by allrelevant actors and create inexpensive approachesto enforce compliance with <strong>the</strong> regulations. Itis <strong>the</strong> inclusive partnerships and a shared agendabetween small and large firms, governments at alllevels, civil society and <strong>the</strong> development agenciesthat will unlock new opportunities. 55To Sum UpIncreasing poverty is a key reason for growth <strong>of</strong><strong>the</strong> informal economy and a main cause <strong>of</strong> <strong>the</strong>blossoming <strong>of</strong> informal enterprises strugglingto overcome legal and institutional hurdles thatmake it difficult prevent for businesses to becomeor stay formal.
