180 '<strong>Ali</strong> ibn <strong>Abi</strong> Tilib in Makkah<br />

(&) and described him as resembling him physically and<br />

in attitude.<br />

4. The virtue <strong>of</strong> Zayd ibn Hiitithah, as the Messenger (a)<br />

said to him: "You are our brother and our freed slave,"<br />

because he was a brother to Hamzah ibn 'Abdul-MuEalib,<br />

since the Messenger (g) had established bonds <strong>of</strong><br />

brotherhood between them. According to his way <strong>of</strong><br />

thinking, he wanted to take on the duties <strong>of</strong> a brother<br />

towards his brother, and duty dictated that he should he the<br />

guardian <strong>of</strong> the daughter <strong>of</strong> Hamzah (&).<br />

5. A woman's mamage does not cancel out her right to<br />

custody, because the Prophet (g) ruled that custody be<br />

given to the wife <strong>of</strong> Ja'far even though the girl's paternal<br />

aunt, Safiyyah hint 'Abdul-Muttalib, was still alive.<br />

6. It is essential that the husband give his permission before<br />

his wife takes custody <strong>of</strong> her sister's daughter, because the<br />

wife's duty is to focus on the interests and benefits <strong>of</strong> her<br />

husband, and custody may affect this interest in part. We<br />

may note here that Ja'far ibn <strong>Abi</strong> Tilib asked for custody<br />

<strong>of</strong> the daughter <strong>of</strong> his paternal uncle Hamzah to be given to<br />

her maternal aunt, who was his wife, which indicates that<br />

he approved <strong>of</strong> that.<br />

7. If a chid is breastfed along with his patemal uncle, he<br />

becomes his brother through breastfeeding, and all his<br />

daughters become daughters <strong>of</strong> his brother through<br />

breastfeeding, so it is forbidden for him to many them.447<br />
