day, he brought h~m out and gave him twenty lashes, then he sad to<br />

him: "I only gave you these twenty lashes because <strong>of</strong> your lack <strong>of</strong><br />

shame before Allah (&) in breaking the fast in am ad an."'^^<br />

3.2.3.b. If death occurs when carrying out<br />

the b dd punishment for drinking alcohol<br />

It was narrated that '<strong>Ali</strong> (&) said: "There is no man on whom<br />

, .<br />

I carry out a hadd punishment and he dies that I feel bad about, except<br />

in the case <strong>of</strong> alcohol. If he dies, I will pay compensation (blood<br />

money), because the Prophet (@J did not prescribe it."253<br />

The mlings <strong>of</strong> Islam came to protect the reason and intellect<br />

with which Allah (g) honoured man, and Islam forbade alcohol,<br />

which takes away man's reason, as Allah (&) says:<br />

$0 you who believe! Intoxicants [all kinds <strong>of</strong> alcoholic drinks], and<br />

gambling, and Al-Anssb [stone altars for sacrifices to idols, etc], and<br />

al-Azlk [arrows for seeking luck or decision] are an abomination <strong>of</strong><br />

Satan's handiwork. So avoid [strictly all] that [abomination] in order<br />

that you may be successful. Satan wants only to excite enmity and<br />

hatred between you with intoxicants [alcoholic drinks] and gambling,<br />

and hinder you from the remembrance <strong>of</strong> Allah and from as-Salih<br />

[the prayer]. So, will you not then abstain?) (Qur'an 5: 90-91)<br />

In this regard, the Messenger <strong>of</strong> Allah (g) said: "Every intoxicant is<br />

kharn~,'~~ and all khamr is hark."255 Hence it is prescribed to carry<br />

out the hadd punishment on the drunkard, and drugs and relaxants<br />

which affect the soundness <strong>of</strong> the mind are forbidden.256<br />

Protection <strong>of</strong> the mind and reason is one <strong>of</strong> the aims <strong>of</strong> Sharia.<br />

Protecting them leads to protecting the other necessities <strong>of</strong> Sharia,<br />

and failing to protect them leads to innumerable evils.257
