through his mother. He remained as the judge during the<br />

caliphate <strong>of</strong> '<strong>Ali</strong> ibn <strong>Abi</strong> Taib and the time when MuZ2wiyah<br />

was in charge, until Ziyid came and dismissed him.?' Abu<br />

'Ubaydah said: "<strong>Ibn</strong> 'AbbL used to issue fatwas to the people<br />

and judge between them."34 Whenever <strong>Ibn</strong> 'Abbh left Basra, be<br />

would appoint Abu d-Aswad to be in charge, and he was the<br />

mufti, as the judge was known at that time. It remained like that<br />

Hamadhiki. He said to him: "Judge as you used to judge." Then<br />

he dismissed him and appointed Shurayh. Al-Sha'bi said:<br />

"Shurayh was the most knowledgeable <strong>of</strong> people about judicial<br />

matters, and 'Ubaydah was equal to Shurayh in that. He passed<br />

some interesting verdicts, and he was one <strong>of</strong> the well-known<br />

scholars <strong>of</strong> Kufah. Shurayh used to consult him and refer to<br />

him."37<br />

12. Muhammad ibn Yazeed ibn Khnlaydah ash-Shaybhi. '<strong>Ali</strong><br />

appointed him as a judge in Kufah, and he issued some verdicts<br />

'<strong>Ali</strong>'s judges in Egypt were also his governors in various<br />

cities, because their governorship was general and included ruling,
