3.3.16. Compensation for one <strong>of</strong><br />

the People <strong>of</strong> the Book<br />

The compensation for killing one <strong>of</strong> the People <strong>of</strong> the Book,<br />

whether a Jew or a Christian, is the same as that for a ~ uslim.~'~ It<br />

was narrated from al-Hakam ibn 'Utaybah that '<strong>Ali</strong> (&) said: "The<br />

compensation for a Jew or a Christian, or any dhimmi, is the same as<br />

that for a ~ uslim."~~~<br />

3.3.17. Compensation for injury to the spine<br />

If the spinal column is broken, causing impotence, the<br />

compensation is the complete amount for a life, according to '<strong>Ali</strong><br />

(&I. He said: "If the back is broken and impotence is caused, then<br />

compensation for a life is due."3z'<br />

3.3.18. The eye <strong>of</strong> one who is one-eyed<br />

If a person puts out the eye <strong>of</strong> a man who is one-eyed, a<br />

complete compensation for a life is due, or the one-eyed man may<br />

retaliate by putting out one <strong>of</strong> the aggressor's eyes and taking half <strong>of</strong><br />

the compensation, according to '<strong>Ali</strong>(4).<br />

That was narrated by <strong>Ibn</strong><br />

~ u d That ~ is because . ~ the eye ~ <strong>of</strong> ~ the one-eyed man is<br />

equivalent to two eyes <strong>of</strong> a sighted person in terns <strong>of</strong> vision. Hence<br />

the compensation is to be paid in full for it.323<br />

3.3.19. Compensation for fingers and toes<br />

The compensation for each digit is one-tenth <strong>of</strong> the amount for<br />

a whole person, according to '<strong>Ali</strong>(4);<br />

in other words, ten camels. It<br />

was narrated from 'ASim ibn Damurah that '<strong>Ali</strong> (&) said: "For<br />

digits, one-tenth <strong>of</strong> the compensation for a life."324 According to<br />

another report: "For digits, one-tenth <strong>of</strong> ~ne-tenth."~'~
