with <strong>the</strong> hazardous nature of <strong>the</strong> transported materials by <strong>the</strong> originator and <strong>the</strong>refore wishes to<br />
unload, dissolve or annihilate <strong>the</strong> load in accordance with <strong>the</strong> valid regulati<strong>on</strong>s.<br />

2.4.3 Waterway transport<br />
The <strong>Europe</strong>an Agreement c<strong>on</strong>cerning <strong>the</strong> Internati<strong>on</strong>al Carriage of Dangerous Goods by<br />
Inland Waterway<br />
The ADN Agreement became effective in 2008 after being ratified by a required number of<br />
seven states. Until today it was ratified by 12 countries – Russia, <strong>the</strong> Ne<strong>the</strong>rlands, Hungary,<br />
Austria, Bulgaria, Luxemburg, Germany, Moldavia, France, Romania, Croatia and Slovakia. The<br />
Czech Republic should ratify <strong>the</strong> Agreement in 2010 but its requirements have already been<br />
adopted (transport of hazardous materials is assessed according to <strong>the</strong> ADN by <strong>the</strong> State<br />
navigati<strong>on</strong> office). The ADN Agreement cannot be interchanged with <strong>the</strong> ADN-R or ADN-D<br />
Agreements which also c<strong>on</strong>cern inland waterway transport of hazardous commodities but <strong>the</strong>y are<br />
issued by <strong>the</strong> <strong>Central</strong> Committee for <strong>the</strong> Rhein and Danube navigati<strong>on</strong>. Although <strong>the</strong>se two<br />
agreements are almost identical with <strong>the</strong> ADN Agreement and <strong>the</strong> differences are insignificant, <strong>the</strong><br />
degree of c<strong>on</strong>sistency is not absolute.<br />
Apart from <strong>the</strong> above-menti<strong>on</strong>ed requirements of <strong>the</strong> ADR, RID and ADN regulati<strong>on</strong>s stated in<br />
<strong>the</strong> chapter “Land transport of chemicals”, <strong>the</strong> ADN requires o<strong>the</strong>r obligati<strong>on</strong>s.<br />
According to <strong>the</strong> ADN, <strong>the</strong> transporter must:<br />
- make sure that <strong>the</strong> hazardous materials are allowed to be transported according to <strong>the</strong><br />
ADN<br />
- make sure that <strong>the</strong> obligatory documents are <strong>on</strong> board of <strong>the</strong> vessel<br />
- make a visual c<strong>on</strong>trol that <strong>the</strong>re are no apparent defects, leaks or cracks <strong>on</strong> <strong>the</strong> vessels<br />
and <strong>on</strong> <strong>the</strong> load, <strong>the</strong> compulsory equipment is not missing, etc.<br />
- make sure that <strong>the</strong> vessel is not overloaded<br />
- make sure that <strong>the</strong> equipment required in written instructi<strong>on</strong>s for <strong>the</strong> vessel commander<br />
is <strong>on</strong> board of <strong>the</strong> vessel<br />
- make sure that <strong>the</strong> vessel is correctly labeled<br />
- make sure that <strong>the</strong> specific requirements c<strong>on</strong>cerning loading, transportati<strong>on</strong>, unloading<br />
and handling hazardous materials in cargo areas or cargo tanks were met<br />
Accompanying documents – apart from <strong>the</strong> documents required by o<strong>the</strong>r regulati<strong>on</strong>s, <strong>the</strong><br />
following documents must be present <strong>on</strong> board of a vessel:<br />
- <strong>the</strong> vessel certificate<br />
