The Law of <strong>the</strong> Land Is <strong>the</strong> Law \\ 83<br />

sou<strong>the</strong>rners established strong bonds of commonality with <strong>the</strong>ir Christian peers.<br />

"It was," as historian Louis Schmier has written, "usually sufficient to silence <strong>the</strong><br />

loudest prejudiced voice, for such war experiences assured local non-Jewish residents<br />

that among <strong>the</strong>m were men, Jews notwithstand<strong>in</strong>g, who had defended and<br />

would cont<strong>in</strong>ue to defend <strong>the</strong> South aga<strong>in</strong>st <strong>the</strong> desecration of its soil and <strong>the</strong><br />

deprivation of its liberty. In both a wartime and postwar South, struggl<strong>in</strong>g for an<br />

identity by glorify<strong>in</strong>g its past and honor<strong>in</strong>g its struggle, that was no small recommendation<br />

for accept<strong>in</strong>g <strong>the</strong> Jews <strong>in</strong>to <strong>the</strong>ir midst, for reassess<strong>in</strong>g malicious<br />

stereotypes of Jews, and for prepar<strong>in</strong>g <strong>the</strong> way for those Jews who <strong>in</strong> <strong>the</strong> follow<strong>in</strong>g<br />

decades were to immigrate to <strong>the</strong> South." 24<br />

The Jews of <strong>the</strong> Old South were nei<strong>the</strong>r <strong>the</strong> victors nor <strong>the</strong> vanquished. And,<br />

<strong>in</strong> fact, slavery played a more prom<strong>in</strong>ent role <strong>in</strong> <strong>the</strong> existence of antebellum sou<strong>the</strong>rn<br />

Jewish life than <strong>the</strong> Jews <strong>the</strong>mselves played <strong>in</strong> <strong>the</strong> emergence and ma<strong>in</strong>tenance<br />

of slavery. The historical rise and fall of American slavery would not have<br />

been affected at all were <strong>the</strong>re no Jews liv<strong>in</strong>g <strong>in</strong> <strong>the</strong> South; and, whatever m<strong>in</strong>uscule<br />

part <strong>the</strong> Jews played <strong>in</strong> <strong>the</strong> historical drama would more than have been compensated<br />

for by o<strong>the</strong>r non-Jewish whites. That <strong>the</strong> Jews benefited, as did every<br />

o<strong>the</strong>r sou<strong>the</strong>rn white, from <strong>the</strong> existence and labor of Black slaves is undeniable.<br />

But, sou<strong>the</strong>rn Jews, like sou<strong>the</strong>rners <strong>in</strong> general, hovered between myth and reality.<br />

"They assumed a certa<strong>in</strong> distance from <strong>the</strong> racial question," one scholar wrote,<br />

"but made every effort to see that religious and economic freedoms were not<br />

harmed by an overt distaste for <strong>the</strong> system.. .and a too visible reaction aga<strong>in</strong>st <strong>the</strong><br />

entire oppressive nature of Sou<strong>the</strong>rn society. This was <strong>in</strong> keep<strong>in</strong>g, after all, with<br />

<strong>the</strong> notion that Sou<strong>the</strong>rn gentlemen—both Jew and Christian—were required to<br />

ma<strong>in</strong>ta<strong>in</strong> a proper and correct attitude at all times. This was to be <strong>the</strong> proper<br />

response even if <strong>the</strong>ir make-believe could not hide <strong>the</strong> glar<strong>in</strong>g <strong>in</strong>equalities around<br />

<strong>the</strong>m." In <strong>the</strong> South, much of whose history has been shrouded <strong>in</strong> myth, <strong>the</strong> Jews<br />

were nei<strong>the</strong>r myth makers nor myth breakers. But one th<strong>in</strong>g is for certa<strong>in</strong>: <strong>in</strong> <strong>the</strong><br />

build<strong>in</strong>g, ma<strong>in</strong>ta<strong>in</strong><strong>in</strong>g, and enhanc<strong>in</strong>g of that myth, sou<strong>the</strong>rn Jews were <strong>in</strong>consequential<br />

at best and <strong>in</strong>visible at worst. They were, to borrow from Ralph Ellison,<br />

just barely <strong>in</strong>side "<strong>the</strong> groove of history." 25<br />
