The right to the exclusive use of the words AIR BARRIER<br />

ASSOCIATION is disclaimed apart from the trade-mark.<br />

WARES: Apparatus, namely hand rollers, utility knives, torches,<br />

propane tanks, pumps, spray guns and paint brushes and<br />

materials, namely, self-adhered sheet membrane, torch-applied<br />

sheet membrane, liquid-applied air barrier, mechanically fastened<br />

sheet membrane, mechanically fastened board stock, primers,<br />

sealants and mastic all for the production and installation of air and<br />

vapour barrier systems. SERVICES: Manufacturing of air and<br />

vapour barrier systems by participating manufacturers; installation<br />

services by an installer with respect to air and vapour barrier<br />

systems; contracting services by a contractor with respect to air<br />

and vapour barrier systems; inspection and auditing services by<br />

an inspector or auditor with respect to the installation of air and<br />

vapour barrier systems. Used in CANADA since as early as<br />

August 2000 on wares and on services.<br />

The use of the certification mark is intended to indicate that the<br />

specific wares and services listed above in association with which<br />

it is used are of the following defined standard: The certification<br />

mark indicates that manufacturers, suppliers, contractors,<br />

installers, inspectors and auditors who set requirements, oversee,<br />

carry out, inspect and install the installation air barrier systems,<br />

have met the applicable standards of installation of air and vapour<br />

barrier systems pursuant to the licensor’s Quality Assurance<br />

Program. The certification mark with respect to wares indicates<br />

that the wares are sold by persons who have met the applicable<br />

standards for installation of air and vapour barrier systems<br />

pursuant to the licensor’s Quality Assurance Program as set out<br />

below. The certification mark with respect to the services indicates<br />

that the services are provided by manufacturers, suppliers,<br />

contractors, installers, auditors and inspectors licensed by the<br />

applicant according to the NABA Quality Assurance Program<br />

Manual ("NABA QAP Manual"), as amended from time-to-time. In<br />

order for a manufacturer or supplier to be licensed, the<br />

manufacturer or supplier must: (a) manufacture or supply air and<br />

vapour barrier products; (b) be a member of National Air Barrier<br />

Association Inc. in good standing; (c) submit their air barrier<br />

products for regular testing by approved testing agencies; and (d)<br />

use approved in-house quality control systems to ensure a<br />

consistent quality product and provide test results to the licensor,<br />

as specified by the licensor in the NABA QAP Manual. In order for<br />

a contractor to be licensed, the contractor must: (a) meet certain<br />

administrative requirements; (b) attend classroom training for a<br />

set number of hours; (c) employ at least one licensed installer, (d)<br />

install all air barrier products in accordance with the requirements<br />

set out in the NABA QAP Manual; (e) conduct site application<br />

verification and complete all documentation required by the<br />

Quality Assurance Program; (f) notify the licensor when the<br />

contractor is the successful bidder on any and all NABA specified<br />

projects; (g) notify the licensor of the project schedule and project<br />

details prior to the application of materials on any and all NABA<br />

specified projects; and (h) submit all project documentation to<br />

licensor, as specified by the licensor in the NABA QAP Manual. In<br />

order for an installer to be licensed, the installer must: (a) meet<br />

certain administrative requirements; (b) attend classroom training<br />

for a set number of hours; (c) be supervised by a certified installer<br />

for a set period of time while demonstrating their skills; and (d) pay<br />

all necessary fees, as specified by the licensor in the NABA QAP<br />

Manual. In order for an inspector or auditor to be licensed, the<br />

inspector or auditor must: (a) meet certain administrative<br />

requirements; (b) attend classroom training for a set number of<br />

hours; (c) complete all requirements for on-going certification (as<br />

necessary); and (d) agree to assess all air barrier systems, as<br />

specified by the licensor in the NABA QAP Manual. All licensees<br />

may be audited and have their products or work inspected and<br />

must comply with the Quality Assurance Program. A copy of the<br />

NABA Quality Assurance Program Manual referenced above has<br />

been filed with the Trade-marks Office.<br />

mastic pour la production et l’installation de systèmes de pare-air<br />

et de pare-vapeur. SERVICES: Fabrication de systèmes de pareair<br />

et de pare-vapeur par les fabricants participants; services<br />

d’installation par un installateur de systèmes de pare-air et de<br />

pare-vapeur; services de passation de contrats par un<br />

entrepreneur concernant les systèmes de pare-air et de parevapeur;<br />

services d’inspection et de vérification par un inspecteur<br />

ou un vérificateur concernant l’installation de systèmes de pare-air<br />

et de pare-vapeur. Employée au CANADA depuis aussi tôt que<br />

août 2000 en liaison avec les marchandises et en liaison avec les<br />
