(j) The EO or designee shall perform periodic monitoring of construction sites and follow the<br />
nonconformance reporting procedures established within the EMS for any observed<br />
compliance deficiencies.<br />
(k) The PM shall correct all compliance deficiencies.<br />
6.3.10 Small Construction Activity<br />
a. Generators shall consider construction and maintenance activities that will disturb equal to<br />
or more than one acre but less than five acres of soil as small construction activities.<br />
b. For small construction activities, the PM shall prepare and implement a SWPPP, sign and<br />
post a construction site notice, notify any Municipal Separate Storm Sewer System (MS4) that<br />
storm water will discharge into, and comply with the requirements in the general permit prior to<br />
disturbance of any soil.<br />
c. PM shall contact the EO in the early planning stages if a project may fall into this category in<br />
order to identify and coordinate the requirements.<br />
d. PM shall ensure that all required actions are completed before de-vegetation or stock piling<br />
of soil begins, including the submittal of a SWPPP and approval by the EO.<br />
e. The PM or designee shall plan, conduct, and document inspections required by the TCEQ.<br />
JSC requires a 7-day inspection schedule (every seven calendar days on a specifically defined<br />
day), which has been approved by the TCEQ as an alternative inspection schedule.<br />
f. PM or designee shall include disturbed areas of the construction site that have not been<br />
finally stabilized, areas used for storage of materials that are exposed to precipitation, and<br />
structural controls for evidence of, or the potential for, pollutants entering the drainage system<br />
in the required inspections.<br />
g. PM or designee shall perform inspections for locations where vehicles enter or exit the site<br />
for evidence of off-site sediment tracking.<br />
h. PM or designated site supervisor shall inspect construction sites after each rain event.<br />
i. The construction contractor shall perform operation and maintenance of controls.<br />
j. The EO shall perform periodic monitoring of construction sites and follow the<br />
nonconformance reporting procedures established within the EMS for any observed<br />
compliance deficiencies.<br />
k. The PM shall correct all compliance deficiencies.<br />
Note: Projects that will disturb an area of one to less than five acres of soil during construction<br />
are considered small construction activities.<br />
