Follow the waiver process when designated items from the EPA or USDA list cannot be purchased with the minimum recommended recycled or biobased content due to one of the four exceptions defined in this chapter. 11.4.2 DLOs shall: a. Ensure that their employees are aware of, and comply with, the sustainable acquisition purchasing requirements; b. Review and revise specifications and standards, as applicable, to eliminate barriers to the preference for recovered and biobased materials; c. Provide data to support annual Center and Agency Sustainable Acquisition Progress Reports. 11.4.3 Onsite Contractors shall: a. Comply with all of the requirements of this chapter, except for the use of the JSC waiver process; b. Develop and maintain a waiver process equivalent to the process described in this chapter for purchasing items that are on the EPA or USDA designated list, but, for approved reasons, cannot be purchased with the prescribed recycled or biobased content; and c. Provide data to support annual Center and Agency Sustainable Acquisition Progress Reports. 11.4.4 The EO shall: a. Implement an awareness program to promote Sustainable Acquisition; b. Provide assistance to Purchase Requisitioners and Contracting Officers on sources for environmentally preferable products and services; c. Review and approve civil service waivers from purchasing EPA and USDA designated products; d. Provide assistance on life cycle cost analysis to Purchase Requisitioners; e. Compile and submit the Center’s Sustainable Acquisition annual data to NASA Headquarters; and f. Prioritize or weigh the evaluation factors and coordinate these factors with the requisitioner and buyer when specific requirements regarding environmental attributes conflict (e.g., choice between recycled content product and biobased product). 11.4.5 The Procurement Office shall: a. Provide guidance and facilitate acquisition planning as requested with respect to environmentally preferable goods and services; Verify correct version before use at http://server-mpo.arc.nasa.gov/Services/CDMSDocs/Centers/JSC/Home.tml. Assist in market research necessary to determine the availability of environmentally preferable goods and services; c. Ensure that solicitations and contracts contain the appropriate provisions, FAR clauses, data requirements descriptions, and applicable Center specific language to implement Sustainable Acquisition requirements; and d. Track Center purchases and provide required information related to the purchase of EPA, CPG, and USDA BioPreferred designated items, as requested by the Environmental Office, for compilation into the annual Center report to Headquarters. 11.5 JSC Waiver Process 11.5.1 Waiver Process for CPG and BioPreferred Designated Items a. The waiver process applies to all CPG and BioPreferred designated item purchases except micro-purchases (credit card purchases less than $3000). (1) Micro-purchases shall comply with CPG and BioPreferred recycled and biobased content requirements, unless the purchase meets one of the allowed justifications listed in Section 11.5.2. (2) To determine the applicability of these requirements for each purchase, the actionee identified below shall: (a) Requisitioner Determine if the item(s) being purchased is a designated item (listed on the EPA’s designated CPG list or the USDA's BioPreferred list as requiring recycled or biobased content). (b) a. If the item is not a designated item, follow normal purchasing procedures and procure the item since it does not require further documentation related to recycled or biobased content. Check the appropriate box under the Affirmative Procurement section on NASA Form (NF) 1707, Certifications and Special Approvals for IFM Purchases. (end of process) (or) b. If it is on one of the designated lists proceed to 11.5.1.2.b Requisitioner Specify and purchase the proposed item(s) with at least the minimum designated percent recycled or biobased content. Check the appropriate box under the Affirmative Procurement section on NF 1707. Track information on purchase(s).
