JSC Environmental Compliance Procedural Requirements JPR No. 8550.1A XXXX.X Effective Date: Johnson Space Center • Environmental Compliance Program Expiration Date: Expiration Date: Page Number 3/25/2011 3/25/2016 [Leave Blank] Page 94 of 123 Executive Order (EO) 13514 stipulates that contractors operating government-owned facilities or vehicles shall comply with the provision of this EO to the same extent as the Agency would be required to comply if the Agency operated the facilities or vehicles. 11.2.5 New Contracts Under EO 13514, all agencies shall ensure that 95 percent of new contract actions for products and services, with the exception of acquisition of weapon systems, are energy efficient (Energy Star or Federal Energy Management Program (FEMP) designated), water efficient, biobased, environmentally preferred, non-ozone depleting, contain recycled content, or are non-toxic alternatives. 11.2.6 JSC, as a center, shall: a. Purchase environmentally preferable products and services to the maximum extent practicable; and b. Review and revise specifications and standards, as applicable, to eliminate barriers to the preference for recovered materials. 11.2.7 All JSC individuals, organizations, and onsite contractors shall: a. Purchase environmentally preferable products and services to the maximum extent practicable; b. Have a waiver in place when purchasing a designated item that does not contain the recommended recycled or biobased content due to a valid justification; c. Consider the use of consensus specifications and/or standards which are maintained for reference at http://nasarecycles.nasa.gov/index.htm; d. Submit and revise specifications and standards to eliminate barriers for using environmentally preferable products and services; and e. Provide data, when requested, to support annual Center and Agency Sustainable Acquisition Progress Reports. 11.3 Requirements 11.3.1 Acquisition of Products The remainder of this chapter will focus on requirements related to acquisition of products to meet the Environmental Protection Agency's (EPA) Comprehensive Procurement Guideline (CPG) and the United States Department of Agriculture's (USDA) BioPreferred Designated Items. 11.3.2 Designated Items for Purchase Verify correct version before use at http://server-mpo.arc.nasa.gov/Services/CDMSDocs/Centers/JSC/Home.tml. When an item falling into one of the designated categories is to be purchased, items are required to be purchased at or above the minimum level of recovered material content or biobased content practicable. 11.3.3 EPA Designated Items The EPA's list of items containing recycled content that federal agencies must prefer when purchasing may be found at: www.epa.gov/epaoswer/non-hw/procure/products.htm. 11.3.4 USDA Designated Items The USDA's list of items manufactured from biobased material that federal agencies must prefer when purchasing may be found at: www.biobased.oce.usda.gov/fb4p/ProposedAndFinalItemDesignations.aspx . 11.3.5 Designated Item Categories These products fall into the thirteen (13) major categories listed below. Most categories have a more detailed list of specific items identified within that category. Construction and Road Maintenance Products Furniture and Furnishings House ware and Cleaning Products Industrial Products Landscaping and Agriculture Products Miscellaneous Products Non-Paper Office Products Paper and Paper Products Parks, Recreation and Outdoor Products Personal Care and Toiletries Transportation Products Utilities Vehicular Products NOTE: The EPA and USDA periodically add products or categories of products to these lists as products become available and economically feasible. 11.4 Responsibilities: 11.4.1 When procuring products or services, all JSC onsite employees (civil service and contractor) shall: a. Consult with the EO or Procurement Office, as applicable, early in the procurement process to facilitate the purchase of designated sustainable acquisition items; b. Utilize statements of work or contract specifications which eliminate virgin material requirements, promote the reuse of products and require the use of products that meet the sustainability requirements in Section 11.2.3 of this chapter, revising statements of work and specifications to include such requirements; c. Purchase products that are compliant with EPA, CPG, and USDA BioPreferred requirements; and Verify correct version before use at http://server-mpo.arc.nasa.gov/Services/CDMSDocs/Centers/JSC/Home.tml.
