<strong>Garden</strong> <strong>Grove</strong> Mixed Use ZonesZoning Ordinance AmendmentC. Consistency with Approved Plans. No final inspection or occupancy clearancewill be granted until all of the l<strong>and</strong>scaping <strong>and</strong> irrigation is installed in accordancewith the approved plans.D. Location <strong>and</strong> Design. L<strong>and</strong>scaping <strong>and</strong> irrigation systems shall be located <strong>and</strong>designed as specified on the approved plans.SECTION 9.18.120.050: Maintenance Requirements <strong>and</strong> ViolationsA. Maintenance. All l<strong>and</strong>scaping shall be maintained in a neat <strong>and</strong> healthycondition. Maintenance of l<strong>and</strong>scaping areas shall include, but not be limited to,the following:1. Irrigation equipment shall be in working condition at all times.2. Litter shall be removed from all l<strong>and</strong>scaped areas in a timely manner.3. All sod areas shall be mowed on a regular basis. Sod areas shall at all timesbe kept green. Accumulation of leaves, bark <strong>and</strong> other similar plant materialsshall be removed in a timely fashion. Planting areas must be kept in a weedfree fashion.4. L<strong>and</strong>scaping maintenance shall include pruning, cultivating, weeding,fertilizing, replacement of plants <strong>and</strong> watering on a regular basis.5. L<strong>and</strong>scape maintenance shall also include pruning or removal of overgrownvegetation, cultivated or uncultivated, that is likely to harbor rats, vermin orother nuisances, or that ca<strong>use</strong>s detriment to neighboring properties orproperty.6. L<strong>and</strong>scape maintenance shall also include the removal of dead, decayed,diseased or hazardous trees, weeds <strong>and</strong> debris constituting unsightlyappearance, dangerous to public safety <strong>and</strong> welfare or detrimental toneighboring properties or property values. Compliance shall be by removal,replacement or maintenance requirements.7. Any removal of mature l<strong>and</strong>scaping must be replaced with l<strong>and</strong>scaping ofsimilar size <strong>and</strong> maturity as that which was removed.B. Prohibition on Use of L<strong>and</strong>scaped Areas. Use of l<strong>and</strong>scaped areas forpurposes other than for l<strong>and</strong>scaping as approved in the l<strong>and</strong>scape plan <strong>and</strong> asauthorized in the amenity area in the GGMU zones shall be a misdemeanor.Willful failure to maintain the l<strong>and</strong>scaping shall be punishable by fine, or byimprisonment, or both fine <strong>and</strong> imprisonment.C. Delegation. The City may delegate to, or enter into a contract with, a localagency to implement, administer, <strong>and</strong>/or enforce any of the L<strong>and</strong>scape WaterEfficiency Provisions on behalf of the City.Section 9.18.120: L<strong>and</strong>scaping 113
