<strong>Garden</strong> <strong>Grove</strong> Mixed Use ZonesZoning Ordinance Amendment1. Breakdown <strong>and</strong> description of the proposed <strong>use</strong>s, including their functional<strong>and</strong> spatial components.2. Statement of the functional area square footage based on the proposed plan.3. Statement of parking dem<strong>and</strong>s by <strong>use</strong>s for morning, midday, <strong>and</strong> eveningperiods, <strong>and</strong> a statement of employee parking dem<strong>and</strong>s.4. A peak-dem<strong>and</strong> calculation by adding the various components together todetermine the midday <strong>and</strong> evening dem<strong>and</strong>s with the higher figurerepresents the minimum number of spaces to be provided.a. A 10 percent increase in the minimum number of spaces shall be added tothe peak dem<strong>and</strong> calculation to allow for future changes in the types of<strong>use</strong>s proposed in the original <strong>development</strong> plan, <strong>and</strong>b. Use changes throughout the life of the project requiring more than the 10percent figure shall require the submittal <strong>and</strong> approval of an amendedparking management plan.7. A cross-check analysis for functional <strong>and</strong> operational aspects.8. Parking management plans shall include a copy of proposed easements orconditions, covenants, <strong>and</strong> restrictions tying the parking agreement to theproject in perpetuity, prohibiting revision without City approval. Pre-existing,shared parking proposals shall be accompanied by a recorded off-site parkingcovenant running with the l<strong>and</strong>. The City Attorney shall have the authority toreview <strong>and</strong> dictate the contents of the CC&Rs <strong>and</strong> any deed restrictions oreasement language proposed.E. Shared Loading Spaces. Loading spaces may be shared in compliance with thisSection. However, the loading spaces shall only be shared if located on anadjoining lot.F. Review Process. For <strong>development</strong> projects involving new construction, aparking management plan for joint or reduced parking shall be considered by theappropriate review authority at the same time the project is considered. Where anew <strong>use</strong> is proposed to occupy an existing building <strong>and</strong> where a parkingmanagement plan is required, the parking management plan shall be subject toCommunity Development Director’s review.G. Required Findings. Where a shared parking facility serving more than one <strong>use</strong>will be provided, the total number of required parking spaces may be reducedonly if the Planning Commission finds that all of the following are true:1. The peak hours of <strong>use</strong> will not overlap or coincide to the degree that peakdem<strong>and</strong> for parking spaces from all <strong>use</strong>s will be greater than the total supplyof spaces;2. The adequacy of the quantity <strong>and</strong> efficiency of parking provided will equal orexceed the level that can be expected if parking for each <strong>use</strong> were providedseparately;Section 9.18.140: Parking 126
