Properties in a Mixed Use zone may also bezoned with the Historic-Cultural Overlay zone.SECTION 9.18.170.020: Permitted Uses. In addition to the <strong>use</strong>s permitted in theunderlying zone, as specified in Table 9.18-1 (Use Regulations for the Mixed UseZones), the following buildings, structures, <strong>and</strong> <strong>use</strong>s shall be permitted in theHistorical-Cultural Overlay Zone:A. Historical buildings <strong>and</strong> structures established in permanent locations on the<strong>development</strong> site.B. Caretaker's residence, when incidental to primary <strong>use</strong>.C. Meeting areas for <strong>use</strong> by the nonprofit historical or cultural organization owningthe property <strong>and</strong> the historical or cultural nonprofit organizations, when incidentalto the primary <strong>use</strong>.D. Limited retail sales of materials related solely to the historical or cultural activityconducted upon the property.SECTION 9.18.170.030: Determination of Historical Significance. The criteriagoverning the designation of a historical or cultural site in the city shall be asfollows:A. Sites. Sites shall be significant to the city or local area's social, cultural,economic, political, religious, or military history, with adequate research <strong>and</strong>bibliographical proof supplied to support the designation of a historical-culturalsite.B. Individuals. The individual sponsored for recognition should have made asignificant historical contribution to the area in one of the aforementioned fields,<strong>and</strong> primary emphasis shall be upon the site of the achievement, rather thanupon the place of birth, death, or grave site.C. Accessibility. The site shall be accessible to the public.D. Ownership. The site must be owned by a nonprofit organization, in accordancewith applicable United States Internal Revenue Service <strong>regulations</strong>.Section 9.18.190: Historical-Cultural Overlay Zone (-HC) 138
