Properties in a Mixed Use zone may also bezoned with the Historic-Cultural Overlay zone.SECTION 9.18.170.020: Permitted Uses. In addition to the uses permitted in theunderlying zone, as specified in Table 9.18-1 (Use Regulations for the Mixed UseZones), the following buildings, structures, and uses shall be permitted in theHistorical-Cultural Overlay Zone:A. Historical buildings and structures established in permanent locations on thedevelopment site.B. Caretaker's residence, when incidental to primary use.C. Meeting areas for use by the nonprofit historical or cultural organization owningthe property and the historical or cultural nonprofit organizations, when incidentalto the primary use.D. Limited retail sales of materials related solely to the historical or cultural activityconducted upon the property.SECTION 9.18.170.030: Determination of Historical Significance. The criteriagoverning the designation of a historical or cultural site in the city shall be asfollows:A. Sites. Sites shall be significant to the city or local area's social, cultural,economic, political, religious, or military history, with adequate research andbibliographical proof supplied to support the designation of a historical-culturalsite.B. Individuals. The individual sponsored for recognition should have made asignificant historical contribution to the area in one of the aforementioned fields,and primary emphasis shall be upon the site of the achievement, rather thanupon the place of birth, death, or grave site.C. Accessibility. The site shall be accessible to the public.D. Ownership. The site must be owned by a nonprofit organization, in accordancewith applicable United States Internal Revenue Service regulations.Section 9.18.190: Historical-Cultural Overlay Zone (-HC) 138
Garden Grove Mixed Use ZonesZoning Ordinance AmendmentSECTION 9.18.170.040: Site Plan Required. A site plan shall be approved in themanner prescribed in Chapter 9.32 (Procedures and Hearings), prior to the issuanceof any building permits for any development in this zone.SECTION 9.18.170.050: Historical-Cultural District. To prevent visual intrusionby surrounding developments in the historical site, and to preserve the historical sitein accordance with the intent of this zone, and for the general welfare of the citizensof Garden Grove, all future improvements, not requiring a public hearing, forproperty within a 200-foot radius of a Historical-Cultural Overlay Zone shall beapproved by the Zoning Administrator before the issuance of a building permit.SECTION 9.18.170.060: Site Development Standards. The site developmentstandards for the Historical-Cultural Overlay Zone shall be the same as the sitedevelopment standards for the base zone, with the following exceptions:A. The size and shape of the site shall be sufficient to allow the full development ofthe proposed use in a manner consistent with the stated purpose of this zone forall essential on-site facilities.B. The proposed development shall place buildings, parking, and open space in anaesthetically pleasing design complementary to the intent of this zone.C. One identification sign shall be permitted provided:1. The display area does not exceed 20 square feet;2. The sign is stationary and non-flashing; and3. The sign is mounted on the wall of a building or securely mounted on adetached wall, provided the maximum height of such wall shall not exceed sixfeet above the ground upon which such wall is located.D. Covenants, conditions, and restrictions are required to guarantee thepermanence of the site for historical use, subject to the approval of the CityAttorney prior to the final approval of rezoning action by the City Council.Section 9.18.190: Historical-Cultural Overlay Zone (-HC) 139
