This Section is established to control <strong>and</strong> regulate l<strong>and</strong><strong>use</strong> activities of a temporary nature. The intent is to ensure that temporary <strong>use</strong>s will becompatible with surrounding l<strong>and</strong> <strong>use</strong>s, to protect the rights of adjacent residences,businesses <strong>and</strong> l<strong>and</strong> owners, <strong>and</strong> to minimize any adverse effects on surrounding properties<strong>and</strong> to the environment.SECTION 9.18.040.020: Authority. The City Manager or designee shall be the reviewauthority for approving or denying a temporary <strong>use</strong>. The City Manager may establishconditions <strong>and</strong> limitations for temporary <strong>use</strong>s including, but not limited to, hours ofoperation, provision of parking areas, signing <strong>and</strong> lighting, traffic circulation <strong>and</strong> access,temporary site improvements <strong>and</strong> other measures necessary to minimize potentialdetrimental effects on surrounding properties. Appeals to the decision of the City Manager,or his or her designee, shall be heard by the Planning Commission.SECTION 9.18.040.030: Temporary Structures. The following temporary structuresshall be permitted subject to the conditions stated in this Section <strong>and</strong> any other additionalconditions as may be prescribed by the appropriate permit.A. Trailer Coaches, Mobile Homes, <strong>and</strong> Modular Structures. The temporary <strong>use</strong> oftrailers, mobile homes, <strong>and</strong>/or modular structures may be permitted only whenpermanent facilities are being constructed or remodeled in accordance with applicablecodes. Such structures may remain on the property only with the possession of a validbuilding permit for the permanent facilities. All temporary office or residential structuresshall be removed prior to the occupancy of the permanent facilities or as required by thesite plan.B. Temporary Construction Buildings. Temporary structures for the storage of tools <strong>and</strong>equipment or containing supervisory offices in connection with major constructionprojects may be established <strong>and</strong> maintained for the duration of construction. Suchstructures may remain on the property only with the possession of a valid buildingpermit for the permanent facilities. All temporary office or construction buildings shall beremoved prior to the occupancy of the permanent facilities or as required by the siteplan.C. Temporary Real Estate Office. One temporary real estate office may be located withinthe boundaries of any recorded residential tract within the city, provided that the officeshall be removed prior to the occupancy of the final structure or as conditioned by thesite plan.Section 9.18.040: Temporary Uses 49
