<strong>Garden</strong> <strong>Grove</strong> Mixed Use ZonesZoning Ordinance Amendment4. The ref<strong>use</strong> storage area shall be located so that the area does not interfere withmotor vehicle circulation on the premises.E. Merch<strong>and</strong>ise Storage or Display. No merch<strong>and</strong>ise storage or display shall bepermitted outside of the building.F. Closures <strong>and</strong> Conversions to Other Commercial Uses.1. In the event that a service station is closed <strong>and</strong> not operated for a period of 90consecutive days, no further sales or services from the station shall be allowed unlessa new conditional <strong>use</strong> permit is obtained <strong>and</strong> the <strong>development</strong> st<strong>and</strong>ards set out inthis subsection are completed.2. If a service station is closed <strong>and</strong> not operated for a period of six months or longer,the premises may be found <strong>and</strong> determined to be a public nuisance, as provided forin Section 3479 et seq. of the California Civil Code.3. Any <strong>use</strong> other than a service station <strong>use</strong> established in a structure that at any timehas been or is being utilized as a service station shall be subject to a conditional <strong>use</strong>permit <strong>and</strong> to the aforementioned <strong>development</strong> st<strong>and</strong>ards. Coin-operated vendingmachines, including, but not limited to, cigarettes, soft drinks or c<strong>and</strong>y, may bepermitted without having to file a conditional <strong>use</strong> permit, provided such vendingmachine(s) shall be located within a wholly enclosed building.SECTION 9.18.030.320: Small Animal Hospital/Veterinary/Dog Day Care. Such <strong>use</strong>sshall be subject to the following conditions:A. Noise. All buildings <strong>and</strong> structures shall be completely soundproofed.B. Outdoor Exercise Areas. Outdoor exercise areas permitted only as authorized by theapplicable conditional <strong>use</strong> permit. Where permitted, the perimeter of all run areas shallbe completely surrounded by an eight foot solid wall. Animal runs are to be constructedin such a manner that no animal can see another animal.C. Incinerator. For small animal hospitals <strong>and</strong> veterinaries, an incinerator of a type asrecommended by the county public health department <strong>and</strong> the South Coast Air QualityManagement District shall be provided. A freezer sufficient to contain the remains ofdeceased animals shall be installed if an incinerator is not provided.SECTION 9.18.030.330: Smoking Lounges. Smoking lounges shall be subject to thefollowing conditions:A. Locations Allowed.1. The premises shall not be located within 200 feet of any residential zone boundary orany property containing a residential <strong>use</strong>, whether said residential boundary orproperty containing a residential <strong>use</strong> is within or outside of the corporate boundariesof the City.2. The premises shall be a minimum distance of 1,000 feet from any public or privateprimary or secondary school, whether said school is within or outside of thecorporate boundaries of the City.Section 9.18.030: Specific Uses – Special Operating Conditions <strong>and</strong> Development St<strong>and</strong>ards 44
