In the GGMU-1, GGMU-2, <strong>and</strong>GGMU-3 zones, nonvehicular vending kiosks may be established as a permanent <strong>use</strong>anywhere on a site except within a required side or rear yard setback area, subject to thefollowing <strong>regulations</strong>. In the CC-3, NMU, <strong>and</strong> AR zones, nonvehicular vending kiosks maybe established as an incidental <strong>use</strong> subject to the following <strong>regulations</strong>.A. Circulation. All kiosks shall be located outside of any area provided for on-sitepedestrian <strong>and</strong> vehicular circulation.B. Security. All kiosks shall have security features designed to guard against v<strong>and</strong>alism<strong>and</strong> other crimes when not in <strong>use</strong>.C. Maximum Footprint. The maximum footprint area occupied by any single kiosk shallnot exceed 36 square feet.D. Uniform Design. Where more than one kiosk is provided on a single site or group ofrelated parcels, the design of the kiosks shall be uniform. Also, for any kiosk locatedwithin the front setback or visible from a public right-of-way, the design of the kioskshall have an architectural quality <strong>and</strong> style compatible with permanent structures onthe same site.E. Maintenance. All kiosks shall be maintained in good condition.G. Permitted Uses. Goods <strong>and</strong> services sold at kiosks shall be those permitted within thezone in which they are located pursuant to Table 9.18-1 (Use Regulations for the MixedUse Zones).H. Location. Kiosks shall not occupy any required parking space or impede vehicular orpedestrian circulation.I. City Review <strong>and</strong> Approval Required. Design, location <strong>and</strong> layout of kiosks shall besubject to the review <strong>and</strong> approval of the Community Development Director or designee.SECTION 9.18.070.020 Vehicular Vending (Food Truck). The preparation, sale,display, <strong>and</strong> consumption of food <strong>and</strong>/or beverages may occur from any vehicle that isparked, stopped, or st<strong>and</strong>ing upon any property where such is permitted as an incidental<strong>use</strong>, as set forth in Table 9.18-1 (Use Regulations for the Mixed Use Zones). Incidentalvehicular vending, where permitted, shall be subject to the following conditions:A. Location. The food truck shall be located on a developed site. The owner(s) of theproperty shall provide written permission to <strong>use</strong> the site. It is unlawful for any person tosell or offer for sale any goods, food or merch<strong>and</strong>ise from any vehicle that is eitherparked, stopped or st<strong>and</strong>ing upon any public street, alley, parkway, or sidewalk.Section 9.18.070: Outdoor Sales of Goods <strong>and</strong> Merch<strong>and</strong>ise 63
