Waste Cleanup Rule<br />
Cleaning up after the animal is the sole responsibility<br />
of the h<strong>and</strong>ler. In the event that the h<strong>and</strong>ler is not<br />
physically able to clean up after the animal, it is then<br />
the responsibility of the h<strong>and</strong>ler to make arrangements<br />
to have someone available who is capable of cleaning<br />
up after the animal. The person cleaning up after the<br />
animal should abide by the following guidelines: Always<br />
carry equipment sufficient to clean up the animal's feces<br />
whenever the animal is on campus. Properly dispose of<br />
waste <strong>and</strong>/or litter in appropriate containers. TSTC may<br />
impose a financial responsibility on the H<strong>and</strong>ler in the<br />
event TSTC staff is needed to cleanup.<br />
Exemptions<br />
Animals involved in authorized research , K-9 animal<br />
(police dog), animals being temporarily held by<br />
Environmental Health <strong>and</strong> Safety, fish contained in<br />
aquariums, or animals used for performance on premises<br />
or involved in College sponsored activity.<br />
Appeal Process<br />
An individual may appeal the decision to the College ADA<br />
Coordinator which can be found in Statewide Operating<br />
St<strong>and</strong>ard ES 3.26.<br />
Grievance Procedure for<br />
ADA-Related Complaints<br />
Primary responsibility for ensuring compliance with the<br />
ADAAA rests with the College’s ADA/504 Coordinator.<br />
The release of <strong>and</strong> access to all student-related<br />
educational records will be in compliance with the Family<br />
Educational Rights <strong>and</strong> Privacy Act (FERPA).<br />
TSTC students who believe that they have been denied<br />
equal access in the form of appropriate accommodations,<br />
modifications, auxiliary aids, effective communication,<br />
or experienced discriminatory harassment as described<br />
in Section 504 of the Rehabilitation Act of 1973 or The<br />
Americans with Disabilities Act of 1990 have a right to file<br />
a grievance. The TSTC procedure for the filing of studentrelated<br />
grievances alleging violations of the ADAAA <strong>and</strong><br />
Section 504 is as follows:<br />
1. The student shall submit a written complaint to the<br />
Office of Access <strong>and</strong> Learning Accommodations or its<br />
designee as soon as the complainant becomes aware<br />
of the alleged violation, but no later than 10 working<br />
days after the alleged action occurred. The time for<br />
submitting a written complaint can be waived for<br />
good cause as determined by the Office of Access <strong>and</strong><br />
Learning Accommodations or its designee. The written<br />
complaint must include the name <strong>and</strong> address of the<br />
person filing the complaint, a brief description of<br />
the alleged violation, <strong>and</strong> any documents supporting<br />
the complaint. The Office of Access <strong>and</strong> Learning<br />
Accommodations or its designee shall assist the<br />
student in the interactive process in an effort to clarify<br />
<strong>and</strong> resolve the issue. At times, the ALA Office or<br />
its designee may consult with the ADA Coordinator,<br />
staff, <strong>and</strong>/or other pertinent parties to assist in the<br />
resolution process.<br />
2. The ALA Office or its designee shall review the<br />
complaint <strong>and</strong> provide the student a response within<br />
10 working days following receipt of the complaint.<br />
An extension of time may be made, not to exceed 15<br />
working days, if the student is notified by the ALA<br />
Office or its designee.<br />
3. If the student is not satisfied with the decision of<br />
the ALA Office or its designee, a written complaint<br />
may be submitted to the ADA Coordinator within<br />
10 working days of the decision provided in step 2.<br />
The time for submitting a written complaint may be<br />
waived for good cause as determined by TSTC’s ADA<br />
Coordinator. The written complaint must include the<br />
name <strong>and</strong> address of the person filing the complaint<br />
<strong>and</strong> a description of the reason for the complaint.<br />
Upon receipt, TSTC’s ADA Coordinator shall review the<br />
complaint within 10 working days. An extension of<br />
time may be made, not to exceed 15 working days, if<br />
the student is notified by the ADA Coordinator. When<br />
necessary, the ADA Coordinator shall consult with the<br />
ALA Office <strong>and</strong>/or the ADA Compliance Committee to<br />
assist in the resolution.<br />
The ADA Coordinator’s decision shall be final at the<br />
College level.<br />
If a complaint is not resolved at the College level, the<br />
student may choose to file a complaint with the Federal<br />
Office of Civil Rights. The Federal Office of Civil Rights<br />
will receive complaints <strong>and</strong> investigate as deemed<br />
appropriate.<br />

during the <strong>Student</strong> Appeals Process by contacting the<br />
Office of Access <strong>and</strong> Learning Accommodations.<br />
