• The Chairperson shall direct proceedings of the review<br />

<strong>and</strong> participate fully in all reviews to include voting.<br />

• The objective of the Board is to review the findings <strong>and</strong><br />

sanctions originally imposed by the Conduct Officer<br />

or designee. The Board may not impose more severe<br />

penalties.<br />

• The decision shall be made by majority vote. All votes<br />

shall be recorded by secret ballot <strong>and</strong> tabulated by the<br />

Chairperson.<br />

• The findings <strong>and</strong> conclusions of the Board shall be final.<br />

• The Chairperson will have three (3) working days to<br />

provide written results of the review to all involved.<br />

General Rules for Reviews<br />

• Reviews are informal proceedings, <strong>and</strong> traditional rules<br />

of the courtroom evidence shall not apply. However,<br />

the Conduct Officer or his/her designee must show<br />

preponderance of evidence <strong>and</strong> that the sanction<br />

imposed was reasonable based upon the circumstances.<br />

• An advisor, attorney, or support person for the student<br />

may be present for the review; however, the advisor,<br />

attorney, or support person may not make statements,<br />

represent the accused, or question witnesses.<br />

• If an attorney accompanies a student for the review,<br />

the attorney shall not be permitted to present evidence<br />

before the Board. The College reserves the right to<br />

counsel in the event it is deemed necessary. The time<br />

frame for scheduling a review may be extended if the<br />

College elects to retain counsel.<br />

Academic Dishonesty Procedures<br />

Procedures for discipline due to academic dishonesty will<br />

first be considered <strong>and</strong> reviewed by <strong>Student</strong> Learning.<br />

Notice of Complaint<br />

• The instructor of record shall give advance written<br />

notice to the student to inform of the alleged violation<br />

<strong>and</strong> to request a meeting at a designated date, time,<br />

<strong>and</strong> location. The instructor shall notify the student<br />

of the alleged violation <strong>and</strong> provide the student an<br />

opportunity for explanation..<br />

• If student chooses not to attend the meeting, the<br />

student automatically waives his/her right to a<br />

conference, <strong>and</strong> the faculty member will make a<br />

decision based solely on the information at h<strong>and</strong>.<br />

Notice of Disciplinary Findings<br />

• The instructor shall assess <strong>and</strong> render academic<br />

sanctions by completing the Academic Integrity<br />

Discipline Report Form. The student shall receive a copy<br />

of the completed form.<br />

• The completed Academic Integrity Discipline Report<br />

Form shall inform the student of the findings, any<br />

academic sanctions imposed, <strong>and</strong> the student’s right to<br />

a review if applicable. The faculty member shall report<br />

the violation <strong>and</strong> sanctions by submitting the form to<br />

the <strong>Student</strong> Conduct Officer via the official incident<br />

reporting system.<br />

Academic Sanctions<br />

• May include reduced or failing grade on an assignment<br />

or examination.<br />

• May include reduced or failing grade in a course.<br />

• May be rendered in addition to other disciplinary<br />

measures imposed by TSTC.<br />

• Further disciplinary sanctions may occur if<br />

circumstances warrant or multiple academic dishonesty<br />

violations.<br />

Review Process<br />

<strong>Student</strong>s may request a Review of the instructor’s decision<br />

to the <strong>Student</strong> Conduct Review Board. A written, final<br />

decision will be provided to the student by the Associate<br />

Provost or designee within five working days of the<br />

<strong>Student</strong> Conduct Review Board’s formal findings letter.<br />

Texas State Technical College (TSTC) is a public<br />

coeducational institution of higher education offering<br />

courses of study in technical education leading to the<br />

award of Certificates <strong>and</strong> Associate of Applied Science<br />

Degrees. TSTC also provides workforce training to business<br />

<strong>and</strong> industry, continuing education to the public, <strong>and</strong><br />

training programs for community <strong>and</strong> state economic<br />

development.<br />
